It is my opinion, the opinion of our Water Resource Specialist, Karen Wilson, and the State D.E.R. (.Bill Kutash) that this system does not work. The developer has requested a revision with a grass dished-out area, with subsurface drain to replace the original plan. This revised system is approved and recommended by all others above: mentioned people and departments.. "The Harbour" -Site Plan Approval DATE: May 7, 19 80 I am in receipt of your inquiry asking whether the City Commission should be consulted prior to City approval of an amendment to the site plan of "The Harbour". It is my understanding that it is the unanimous concensus of all affected City departments that the proposed amendment represents a sub- stantial improvement over the site plan as originally approved. Section 34. 03, Appendix A on Zoning, provides for submission:of a preliminary site plan which ultimately is presented to the City Commission. A final site plan must be approved by the City Manager, but approval by the City Commission "is waived for the final plan if it is substantially within the limits of the preliminary plan as previously approved and of record. " The amended site plan is in effect the final site plan. Any previous plan, even one heretofore designated as a final site plan, would be superseded by the - amended plan and hence would be considered a preliminar}~site plan. Under the above-quoted ordinance, the City Manager has the authority to grant permission to amend the site plan without submission to the Commission, if the amendment does not substantially alter the proposed development. Whether the revised drainage system constitutes a substantial change might best be ascertained by consulting Engineering, Building, ox Planning; but it is my opinion that it is within your discretion to decide, on the basis of your own knowledge, that the final site plan is not so substantially different than the preliminary site plan as to require submission to the City Commission. Certainly the fact that the various departments unanimously support the amendment may be considered in reaching your decision, as may the time constraints, if any. / . Frank X. SUBJECT: Revision to Site Plan "The Harbour" DATE: 4/24/80 The original site plan was approved by the City Commission with a rock sand filled concrete box to filter storm water. It is my opinion, the opinion of our Water Resource Specialist, Karen Wilson, and the State D.E.R. (Bill Kutash) that this system does not work.. The developer has requested a revision with a grass dished-out area, with subsurface drain to replace the original plan. This revised system is approved and recommended by all others above mentioned people and departments.
