STAFF COMMENTS: This is a request for conditional use approval for a congregate care facility proposed to be established at 620 Belleair Road. The applicant is seeking this conditional use permit in order to be allowed to establish a residential care facility for those suffering from Alzheimer's and related dementia. The applicant also has a concurrent application before this Board for the proposed rezoning of this property from the General Commercial District to the Neighborhood Commercial District. The applicant has submitted a site plan of the subject property that indicates the location of seven residential structures and a central commons building. The applicant has indicated that the proposed facility will have a maximum of 98 beds and the commons building will be utilized for group activities and administrative offices. The proposed facility will provide residents with personal care related to daily living and will be licensed as an assisted living facility. Medical or nursing assistance will not be provided at this site. The submitted site plan indicates development within the existing Bryant Street and Cross Lane rights-of-way. The applicant is currently working with the public works department to apply for the vacation of the impacted portion of these rights-of-way. The public works department also advises that existing utilities will need to be relocated prior to development. Staff has identified several concerns relating to the submitted site plan and existing environmental conditions of the subject property. Staff recommends the following issues be addressed by the applicant: • A Transportation Impact Report is required to determine how the proposed use will impact existing roadways. • An environmental analysis of this site is required to determine the significance and jurisdiction of the existing creek located within the northern portion of the site and how the proposed development will impact this creek. • An accurate tree survey is required to determine existing tree cover. The applicant is advised to consult with the City' Landscape Architect with regard to how the proposed development will impact these existing trees. • The applicant is advised to consult with the City's Public Works Department with regard to drainage, utility relocation, and right-of-way vacation.
