From inception, which was prior to your appearance in this matter, we stated that a comprehensive plan (Lots 1 thru 12) mast be submitted with appropriate supporting technical documentation for all owners to review. We were told that the report that was being prepared by ANCL©TE ENGINEERING would be all inclusive. It was not. What was submitted on December 20, 1990 was only a partial grading plan. It did not contain: 1. Supporting technical information and documentation; 2. Proposals for implementation. 3. Warranties for all phases of the plan; 4. Written agreement from Donaldson and written financial commitment; and 5. Failed to incorporate all a0ove referenced lots. Therefore, a comprehensive plan was not presented. No technical data or plan was submitted that supports that statement; that the full 15 foot wide drainage easement must be cleared and re-graded. 2. The owner of ANCLOTE CNGINEERING, Mr. Marcus Vernon, who presented the partial grading plan, made a statement that if the plan were implemented a5 presented, there would be no -flooding. 3. Mr. Vernon, when asked to give the property owners a letter, warranting his statement, refused. Piecemeal unsupported proposals that only placate one owner are not acceptable to us. Yes, Mr. Katz, it would certainly be nice to be able to say that this matter has now been reiolved, as you stated in your letter, and it would please the owners of Lot 10 more than anyone, but, the fact clearly remains, NO work will be done to Lot 10 until eve have a signed agreement.
