On the other hand, Judge Fogle stated that the City is not bound to any other plans prepared by Peter Marich nor to any height or item (e.g. roof) not described in the structural plans. We have examined the Peter Marich structural plans for purpose of determining any additional height allowances to which you may be entitled above those heights set forth in the original ?Ii_lliams and Walker plans. The enclosed chart, which includes benefit to your client of any doubtful dimension, shows the heights of the various building elements to which you are thus entitled. You will note from the chart that the maximum allowed building height U above the finished floor of the parking/lobby area is 56 feet, inches. Using the elevation of the lobby floor above mean sea evel (MSL) as shown on the Peter Marich plans (8 feet, 8 inches), the maximum allowed building height above mean sea level is 64 feet, 8 inches. The plan dated October 11, 1982 and submitted by Mr. Marich last week showing a re-designed roof assembly shows a pro- posed building height (average of all roof sections) of.approxi- mately 65 feet, 5-1/4 inches MSL. A building height of 64 feet., 8 inches MSL is the max:iflUM allowed and may not be exceeded. i Before the City can honor the request it received on October 27, 1.982 for an inspection of the top floor, it will be necessary that the architect provide drawings or other documents showing how the top floor of the building integrates with the roof/ceiling assembly and how the top floor can be constructed without causing the building height to exceed the maximum allowed height. July 1, 1982, upon the Motion of the Defendant, COSE-BELLE COMPANY, INC., to dismiss the Second Amended Complaint of the Plaintiff, the CITY OF CLEARWATER in the above-styled action, and the Court having received argument of counsel, having reviewed the file, having requested briefs to be filed in support of the Motion and in reply thereto, and the Court having reviewed and considered the briefs filed herein, the Court finds as follows: 1. In the first instance the City of Clearwater filed the suit prematurely, in that the earliest date it could have used in applying the two year time limit for completion of Defendant's building project would have been two years from issuance of the building permit, which would have been in July, 1982, a date which had not occurred at the time of the suit. 2. But even more significantly and determinative of the matters at issue, the Court further finds that there is no basis in the Code of Ordinances for the City of Clearwater for a time limitation on the completion of building construction, and before such..a limitation can be imposed as a condition on building and therefore a restrictive condition on-an owner's property rights, a proper ordinance must first be enacted. The developer's architect is requesting that the site plan be administratively amended to achieve the following: 1. Increase the parking beneath the building from 14 to 18 spaces, 2. Decrease the parking around the periphery of the building, from 13 to 9 spaces, 3. Delete the carports adjacent to the east property line, 4. Relocate the retention area from north of the swimming pool to south of the parking area adjacent to the east property line, 5. Increase the internal landscaping area. I am attaching for your information and review a copy of the architect's letter requesting the change and a copy of the revised plan. You will recollect that the developer requested of the City Commission at their November 5, 1981 meeting that the two year time limit to complete the project be extended, The Commission denied the request because the site plan does not comport with the present RM-20 zoning. In light of the Commission's prescribed completion date, I recommend that the plan change not be administratively approved. BACKGROUND: The property is locate d'between Idlewild Street and Glendale Street fronting on the Gulf of Mexico. The .65 acre site is being developed with the Marinos Condominium Apartments. - The Land Use Plan classification is High Density Residential. The zoning designation is RM-20 (High Density Multi-Family Use) District. Plans are to develop a six story building with ground level parking containing 18 dwelling units yielding a density of 28 units per acre.. the rezoning of mid-Clearwater Beach was in progress and under consideration from approximately Sep tember,.1979', continually through June, 1980, at which time the City Commission rezoned major portions of the mid-beach, including the subject property from RM-2$ to RM-20. During the course of this pro- ceeding, and prior to the City Commission adopting a policy in April, 1980, based on the "Cooper' s. Point decision," whereby no site plan would be accepted for review once a rezoning action was pending, said plan was submitted and approved on February 21,-1980. A condition of approval of the site plan was "issuance of initial building permit within six months from approval date and total project to be completed within two years". The site plan immediately became non-conforming under the RM-20 district with respect to both density and building height. Permits were drawn on the property on July 17, 1980. Subsequently in December, 1980, said permit, not having been acted upon, was extended from the period January 17, 1981 through April 16, 1981. An inspection by the building department on April 13, 1981 validated the building permit for an additional six months to October 13, 1981, during which time inspections have been made allowing the permit to X_, remain valid. As per the original condition of approval, the project is to be completed and ready for occupancy within.two.years.. The developer is requesting an exten- sion of the. completion date provided for on the original condition of site plan approval. The extension, if granted, would permit the continuation of construction under the provisions of the RM-28 zoning regulations. It is my understanding that a developer's request. for an extension to the allotted time in which to obtain the permit is routinely granted by the Building Department. In most instances, this causes no problem. However, during' the time period allotted by the Commission for the developer to draw his building permit,a rezoning action, land use plan amendment, zoning code.change, etc. occassionally renders a plan inconsistent with present day development regulations.
