Cianfrone, of the law offices of Becker & Poliakoff, P.A., I hereby respond. On September 3, 1992, the City Commission approved the Clipper Cove II site plan subject to conditions from the Development Review Committee. The final site plan was certified on December 7, 1992. At that point in time, it was the understanding of City staff that the subject development was the second phase of the existing Starboard Tower Clipper Cove Condominiums, and the Clipper Cove II development was under one and the same ownership with the existing Starboard Tower Clipper Cove Condominium, which abuts the subject property to the north. During a meeting with Jim Polatty, Lou Hilton, developer Bruce Dore, condominium representatives of the Starboard Tower Clipper Cove Condominium Association, Bob Wright and Salvatore J. Bruno, it was clearly represented to staff that the properties were intended to remain one property unified by title, with shared use of the existing swimming pool facility located behind the Starboard Tower Clipper Cove Condominium building. At the time the site plan was being reviewed by city staff, the phase line shown on the Clipper Cove II site plan was not recognized by code as a property line, therefore, a side setback requirement did not apply to the Cutter Cove II development proposal. The existing Starboard Tower Clipper Cove Condominium building footprint was not shown on the preliminary or final certified site plan, and was therefore assumed to meet the City's building separation requirements. Building separation dimensions and/or requirements between the proposed 36 ft. high Clipper Cove II and the existing 160 ft. high (approximate) Starboard Tower Clipper Cove Condominiums were not provided on the preliminary or final site plan. As a result, the foundation has been poured for a 12 unit building which is located approximately 34 feet from the Starboard Tower Clipper Cove Condominiums where a separation of 68.6 feet is required. July 7, 1988 On October 22, 1987, the Development Review Committee (D.R.C.) approved a final site plan for the above referenced proposal subject to the following conditions: 1. Signs and fencing are subject to separate review and permitting processes. 2. Easements must be obtained for the proposed private drive across the abutting property prior to the issuance of a building permit. 3. Storm water detention must be provided on the site as required by the Public Works Department and shown on the final site plan. Any adjustments to provide such detention which necessitates relocation of parking, building, or other major items on the plan, will necessitate an additional review by this committee. (The Department of Public Works has reviewed the latest drainage proposal and finds it to be acceptable.) 4. A fire hydrant must be provided at the entrance of Island Way or Dory Passage. (Has been provided.) 5. The certified plan must be signed and sealed by a registered engineer. (The plan submitted for certification has been signed and sealed by a registered engineer.) y 6. DER and SWFWMD permits must be provided to the Public Works Department prior to the issuance of a building permit. 7. The applicant has submitted a site plan revised as required by the D.R.C. and modified with the addition of automobile carports and a revision to the drainage proposal involving the consolidation of the drainage retention into a single basin. The proposed carports meet required setbacks from property lines. The Department of Public Works has reviewed the change to the drainage proposal and finds it to be acceptable. I have received a copy of the letter of February 28th, 1994, sent to you by Joseph Cianfrone on behalf of the Starboard Tower Clipper Cove Condominium Association, Inc., and I thought it might be helpful to have some additional information to assist you in this matter. In 1992, a Site Plan application was processed on my client's propery through the City and final approval obtained in late 1992 or early 1993. At a September 3, 1992 City Commission meeting, this site plan was discussed and Bob Tankel of the Becker & Poliakoff firm objected to the approval of our Site Plan on behalf of the Starboard Tower Clipper Cove Condominium Association. Subsequent to that September 3rd meeting, extensive meetings and negotiations took place between Island Development General Partnership through its general partner, Mr. Fred Arnold, and the Starboard Tower Clipper Cove Condominium Association. These negotiations culminated in an agreement executed between the two parties on November 23rd, 1992, a copy of which I have enclosed. By letter dated November 20th, 1992 (copy enclosed), Mr. Tankel, on behalf of the Starboard Tower Clipper Cove Condominium Association withdrew its objection to the construction of the project and my client's site plan. Based on that letter and the subsequent final approval of the site plan by the City, the property was then conveyed by Island Development Partnership to Cutter Cove Development Corp. Cutter Cove began marketing the individual 53 condominium units that comprise its development. They were issued building permits by the City of Clearwater and have completed construction and obtained a Certificate of Occupancy for one building, and will soon complete a second building. The building referenced in Mr. Cianfrone I s letter is a twelve- unit building which is Building 1 on my client's condominium plat and site plan. A foundation permit has been issued by the City of Clearwater and a foundation constructed. Four of the twelve units in that building are currently under contract with individual purchasers to whom my client is obligated to construct and deliver individual residences in a timely manner. This past week a representative of Creative Contractors was denied a building permit to continue construction of the above- ground portion of that building by the City of Clearwater. Of the 53 potential units in this development, 18 are under contract. Any change in the Site Plan or condominium offering circular would jeopardize these contracts and could be a financial disaster to my client. If the City continues to refuse the requested building permit, my client has no alternative but to look to the City for compensation for the damages they will suffer. Demand is hereby made upon the City to issue the aforementioned permit by the close of business on March 11, 1994. Box 4748 Clearwater, F134618 RE: Cutter Cove - continuing drainage problems Dear Mr. Baier: J U .'! 5S On Friday, April 5th, I received a call from Mr. Bob Maran advising that the final Certificates of Occupancy for Cutter Cove will likely be granted by the end of this week, and he asked if everything concerning the drainage problems was now satisfactory. He asked that I call him yesterday morning. After several attempts, I was finally able to speak to Mr. Maran yesterday afternoon. At that time, I advised him that there was definitely an improvement resulting primarily from Cutter Cove's installation of a grate in the walkway leading to the pool area. However, we still were having considerable water in the grass areas directly adjacent to the north fence, and in the area just to the east of where the grate was installed. The accumulation of water in these areas was such that our plantings, trees and grass will not survive. The cause of this water is in our opinion twofold. 1. The down spout on the north/west corner of the building immediately south of Clipper Cove, is not directed to the south side of this building., but to the. north. All this waters being dumped 2nto the proble..m. a.---.- which the grate was to correct. 2. The swale which leads from the grate in a westerly direction, needs to be graded to allow flow to the west side retention area. This swale exists only for about 30' or so, and then rises to a height level with our pool area. It is obvious to anyone who looks at this condition, that once water fills the swale area, it will flow onto our property. I asked Mr. Maran to meet with me, yesterday or today, so that he could see the problem and hopefully demand a correction from Cutter Cove, before approving the final Certificates of Occupancy. He would not agree to this. Upon my insistence, he agreed that he would stop by sometime before Wednesday afternoon, but would not set a specific time so that I or one of our board members could meet him. Since this project was proposed, we have had many discussions, and much correspondence over this issue. Mr. Cianfrone called me on the morning of March 9 to inquire about his letter so he could advise his client as to the status of their assertion that a townhouse building is being constructed too close to a line between Cutter Cove and the Starboard Tower Clipper Cove Condominium Association property. I told him that our position was "confused, at least temporarily." I have since met with Scott Shuford and Lou Hilton to review the matter. Our position is no longer confused. The purpose of this letter is to set forth our position. We have examined the site plan, which was approved in September of 1992 and certified on December 7, 1992; a letter to Mayor Garvey from Robert Tanke 1 of Mr. Cianfrone's law firm dated November 20, 1992, on behalf of Starboard Tower Clipper Cove Condominium Association, Inc., withdrawing prior objections to the site plan and objections to the construction of the project; and a copy of an agreement dated as of November 23, 1992, between Starboard Tower Clipper Cove Condominium Association, Inc., and Island Development, a Florida general partnership, executed by Fred Arnold, general partner, developer of Cutter Cove. The properties were once under common ownership and were treated by the City as a single property; that is, Cutter Cove was understood to be the second phase of the Clipper Cove development. At the time the site plan was reviewed by city staff, the line between Cutter Cove and Clipper Cove was considered-to be a line between two phases, not a property line; thus, the code-required setback from a "Equal Employment and Affirmative Action Employer" _ property line was deemed inapplicable. The approved site plan shows a setback from the "phase line" of five feet at the narrowest point to a somewhat greater setback at the other end of the setback- line. This is the site plan which was approved in the fall of 1992, and the site plan which was "on the table" when the Starboard Tower Clipper Cove Condominium Association removed its objections in November of 1992. We understand that the Cutter Cove property has since been platted, the plat being recorded in February of 1993, with Cutter Cove Development Corporation shown as the owner. The plat was not processed or approved by the City of Clearwater and we do not recognize its validity for land development code purposes. The developer, Bruce Dore, will be requesting the last Certificate of Occupancy towards the middle of the week. From my standpoint of the City of Clearwater Engineering Department, the developer has met all the concerns related to his development which have been brought to our attention by the previous management of Clipper Cove. The following is a list of concerns and solutions proposed: 1. Cutter Cove stormwater runoff and soil was being washed onto the pavement of Clipper Cove which was located directly east of Cutter Cove. Solution: Cutter Cove constructed a small curb wall along the east side. of their project and directed roof drains onto their own site which drains to the west away from the Clipper Cove parking lot. 2. Roof drainage from the building at the northeast corner of Cutter Cove was draining north onto the grassed area in Clipper Cove. Solution: Cutter Cove constructed an oversized roof drain to direct roof drainage to the west away from area south of Clipper Cove. 3. The sidewalk in Cutter Cove that goes north to the pool in Clipper Cove was directing runoff onto -the pool area of Clipper Cove. Solution: Cutter Cove cut out a section of sidewalk and constructed a grate to direct water into a grass swale to carry to s • Mr. Henry Modzelewski April 19, 1996 Page Two water to the west to the detention pond. 4. The grass swale along the north side of the northwest corner of Cutter Cove had a slight backfall to the east although high point in flow line of swale curves 3/4 ft. lower than the connector sidewalk. Solution: Although this was not in itself a drainage problem, the Cutter Cove developer was requested to regrade the grass swale so that no standing water would rest in swale after a storm. 5. It was brought to our attention that several sections of sidewalk were damaged during construction. Solution: The developer has repaired all broken and damaged walk and provided $2500.00 to the City for sidewalk ramps to meet A.D.A.(American Disability Act) requirements. The A.D.A. ramps were constructed within the City's annual sidewalk contract. Although the contour elevations of the land adjacent to your development have been altered, it has been reported to my Department that some drainage issues existed prior to the completion of this phase of the development. I firmly believe that the aforementioned action on the part of the City and the developer should remediate runoff associated with this phase of the development. INTRODUCTION The Islander is planned to be a 69 unit high-rise condominium ' building in the community of Island Estates in the City of Clearwater. The building will be located on a 2.5 acre parcel ' between Island W ay and Larboard Way north of Dory Passage (see Figure 1). This report is being prepared in accordance with Section 136.028 of the City of Clearwater Code of Ordinances. Prior to preparing this report, a meeting with the City Traffic Engineer was held on April 16, 1990, to discuss an appropriate methodology, subsequently the following traffic study procedures were f'ollowed: A. Data Collection Procedures Traffic counts were obtained from the City of Clearwater for the segments of the Memorial Causeway immediately east and west of the Island way intersection. Traffic counts were taken by King Engineering Associates, Inc. on Island way immediately south of Dory Passage for a 24 hour period on April 17-18, 1990. In addition, signal timing plans were obtained for the Memorial Causeway/Island Way intersection to assist in the roadway capacity analysis of both roadways. The traffic count reports are shown in Appendix A. B. Site Traffic Generation Procedures Trips expected to be generated by the project were determined using average trip rates from the Institute of 1 Transportation Engineers (ITE) publication, Trip Generation, 4th Edition. Traffic generated by the project was estimated using ITE Land Use Code 232 (High- Rise Condominium) and the appropriate enter/exit split was applied. C. Site Traffic Distribution Procedures ' The distribution and assignment of PM peak hour site generated traffic was based on percentages determined ' from traffic counts on the Memorial Causeway obtained from the City of Clearwater. ' D. Capacity Analysis Procedures Existing and future operating conditions of roadway links were analyzed using the FDOT Generalized Maximum Service ' Volume Tables and accompanying software. Peak hour peak direction was analyzed as directed by the City of ' Clearwater Traffic Engineer. II. EXISTING CONDITIONS ' The Memorial Causeway is a four lane divided arterial which connects Clearwater Beach to Downtown Clearwater. This roadway has approximately two traffic signals per mile. ' Island Way is a four lane divided collector roadway which serves as the sole access to the Island Estates community, capacity of this roadway is basically controlled by the signal at the Memorial Causeway intersection. ' On the Memorial Causeway an average of 1,835 vehicles per hour ' were counted in the eastbound direction and 1,148 were counted in the westbound direction. The four highest consecutive 15- minute periods between the hours of 4-6 PM were chosen, these ' volumes occur between 4 and 5 PM. On Island Way, traffic counts performed by King Engineering show that during 4-5 PM ' 544 vehicles were counted (255 northbound and 289 southbound). Based on the traffic count data, roadway link levels of service were determined. The counted volumes were compared with the level of service (LOS) D maximum service flow rates (MSFR) calculated by the FDOT LOS Software (See Appendix B). The Memorial Causeway operates at LOS B carrying 1,835 ' vehicles in the peak direction (eastbound) during the 4-5 PM peak hour. Island Way operates at LOS D carrying 289 vehicles in the peak direction (southbound) during the 4-5 PM peak hour. III. FUTURE CONDITIONS This section contains trip generation, trip distribution, and traffic assignment information and analyzes the expected ' operating conditions with the development in place. Trips generated by the project are expected to be 289 on a daily basis and 26 during the PM peak hour. A PM peak hour ' enter/exit split of 62$/38% results in 16 trips entering the site and 10 trips exiting the site. Site generated traffic was distributed and assigned 100% to/from the south on Island Way, then 60% to/from the east on ' the Memorial Causeway and 40% to/from the west on the Memorial Causeway. Figure 2 shows the distribution of project trips on ' the roadway. ' The project will add a total of 26 PM peak hour trips to the Memorial Causeway, 16 to the segment east of Island Way (6 ' eastbound and 10 westbound) and 10 to the segment west of Island Way (6 eastbound and 4 westbound). The project will add 26 trips to the segment Island Way between the site and the Memorial Causeway (16 northbound and 10 southbound). The peak hour, peak direction LOS D "capacity" of Island Way has been determined to be 770 vehicles per hour. The project impact represents 1.3 % of the peak hour peak direction "capacity" of Island Way and with the project traffic added Island Way would ' operate at LOS D carrying 299 vehicles in the peak direction (southbound) between 4 PM and 5 PM. IV. CONCLUSION ' The Islander condominium complex is expected to generate 289 vehicle trips per day, and 26 trips during the highest hour ' between 4-6 PM. With project traffic added, Island Way and the Memorial Causeway would continue to operate at acceptable ' levels of service, therefore, adequate transportation infrastructure currently exists to accommodate the minimal 1 impacts of this development.
