Presently development of this parcel is limited to 55,000 square feet of gross floor area for uses permitted under the OG (General Office) zoning on the property. The square footage limitation on development of this site is part of an annexation agreement between the City of Clearwater and The Mills Land Development Group, Inc. executed on October 12, 1982 and recorded in O.R. 5436, Pages 311-320,. Pinellas County. The proposal you have offered would be to amend the agreement to permit 64,000 square feet of gross floor area on the site. In consideration of allowing this increase you also have offered additional sidewalk construction, access . road widening and monetary contribution for park improvements. It is the opinion of staff in reviewing your.offer that the 55,000 square feet limitation should remain in force in accordance with the agreement and we would so recommend to the City Commission. The sidewalk extension would be of benefit to the City, but in and of itself, does not mitigate the impacts of an additional 9,000 square feet of office space in this area. The widening of the access road adjacent to the site has already been made a requirement of the most recent site plan submission for the Dyson Countryside Office Building on this site. The adjacent city parkland is a heavily wooded area and is not proposed to be made an active park/recreation facility, therefore, the $25,000 offer for improvement of this park area would not be considered justification for granting additional square footage of office space. p5F Page Two. Regardingthe First Ymprovement the sidewalk extension: This would certainly be a desirable improvement or t e area (would consist of approximately 180 feet of new sidewalk in the city right-of-way abutting the Florida Power Corp. right- of-way to the west of this site). 2. Regarding the Second Improvement, the widening of a portion of the access road serving the Cypress Point Shopping Center: On October 30, b, the D.R.C. required the meowing as a condition in approving the final site plan for this site: To accommodate truck traffic the drive going out to Enterprise must be widened to 30 feet. (Therefore, the City has already required this widening in approving the site plan.) 3. Regarding the Third Improvement, the contribution of $25,000 toward site improvements for the propose ar a jacent to their property: I spoke wit Ream Wilson, Director o Parks an Recreation, and there are no definite plans at this-time for that parkland. It is not suitable for an active park because it is heavily wooded. Ream would not want the applicant to contribute $25,000 and expect the city to develop this park in the immediate future as it is not a priority site and there are no other city monies to develop it at this time. Therefore, Ream feels this proposed improvement is not a major reason to grant the applicant's request for additional office development on the subject site. Please advise me as to a response to the applicant concerning this request as identified in the attached copy of the applicant's letter. Dear Sandy: As you are aware, the Opus South corpor'ati'on is in discussions with a office user of approximately 64,000 square feet for our site in the Countryside area of Clearwater. Our 5.8 acre site is located on Enterprise Road just east of US 19. Unfortunately, we are restricted to a 55,000 square foot building. This restriction is the result of an agreement between the City of Clearwater and a previous property owner. According to the City's records, the property owner agreed to restrict development to 55,000 square feet on the site in order to receive a higher density of retail at the Cypress Point Shopping Center. Therefore, we request that the City of Clearwater and Opus South reach a new agreement that would enable us to increase the allowable density on the site provided that we would fund several improvements in the area which would be of benefit to the general public. First, in order to create a more conducive pedestrian environment, we would extend the sidewalk from our site to the Enterprise Federal Building to the west. Second, we would widen a portion of the access road serving the Cypress Point Shopping Center.. Currently, the road has an inadequate turning radius for trucks serving the center. Third, we are willing to contribute $25,000.00 toward site improvements for the proposed park adjacent to our property. The site could be developed into an attractive open space prior to being developed into an active park. In addition to these benefits to the City and its residents, there will be over 300 employees working in the building and it would generate approximately $80,000.00 in new property taxes annually. The zoning on the property at.-the -time__. of .-annexation -.was PS.. (Professional Services).:.. On October 12, 1982, the City entered into an agreement with the property owner that limited development on the property to 55,000 square feet of gross floor area. Also, in Section 3. e. of the agreement, it was noted that the City was in the process of redrafting the zoning code, and the owner agreed to be bound by the substantive provisions contained in the zoning district (OG) applicable to the property as set forth in the new zoning code. A sale of this property is now pending and awaiting a determination from the City as to which provisions of the agreement shall apply to the subsequent development of the property -- the 55,000 square foot floor area limitation or the provision of the .4 FAR of the OG.zoning district in the new code which would allow up to 82,938 square feet of floor area.or even more if the provisions of Section 135.094 (7) are met. BACKGROUND: The 5.85 acre MOL site is zoned OG (General Office District) and AL/I (Aquatic Lands-Interior District) with a Land Use Plan designation of Residential/ Office. The applicant proposes to construct a 54,600 square foot three-story office building on the OG zoned portion of the property. Access to the site is proposed at one point on Enterprise Road and at two points from the adjacent entry drive to the Cypress Point Shopping Center. This property was annexed into the City of Clearwater in 1982 (please refer to attached copy of annexation agreement).
