(SUB 88-14) RATION: City Commission review the preliminary subdivision plat for the Replat of Parcel 3 of the Tillage at Countryside and authorize review of a preliminary plat with final action by the D.R.C. subJecty to the conditions listed on attached page 2. [X3 And that the appropriate officials be autherixed to eaxocute same. r 'The applicants are requesting approval of a preliminary plat in order to divide the subject platted parcel into two lots for the purpose of separate ownership. The property is developed with two separate office buildings. The existing platted lot conformed with applicable zoning and code requirements at the time of its creation, but waa made nonconforming as to lot area and width through the subsequent rezoning of the property to CC (Commercial Center) in 1985 with the adoption of the current Land Development Code. Provided these legal noncomformities are not increased, division of thist parcel is emitted. A Unity of Title, amended for more than one owner, tying the two proposed lots ogether for the purpose of development included with this plat would enable the applicants to obtain approval of the proposed subdivision without requirement for variance. The applicants are amenable to this requirement. It should be further noted that there is a certified site plan on file known as Countrysides Village Tracts 45, 72, 73 and 74 which contains this parcel and restricts development. While it is a formality in this case, approval by D.R.C. of a variance to the subdivision regulations requiring all lots to have direct access to a public street will be necessary or one of the proposed new lots. Access for this parcel to public streets is via internal rives through the Countryside Village Tracts 45, 72, 73 and 74 site, as approved on the certified site plan.
