Dear Mr. Serrabella:
This letter is to summarize our recent discussions regarding relocation of the 60 inch storm drain
on the subject property. As you wish to develop this property without the encumbrance of the
deteriorating storm drain and requisite drainage easement, and the City wishes to upgrade the
storm drain and relocate it off of private property; the following understanding has been reached.
Responsibilities of the Tire Kingdom development:
• Deed the northern 20 feet of the subject property to the City. This will leave sufficient on-site
area to construct the proposed parking lot and provide the required ten foot landscape buffer
adjacent to residentially zoned property.
• As a part of site development, construct a new storm drain within the above 20 feet of
property and also along the David Avenue right-of-way south to the existing storm manhole
(approximately 260 11 total).
• Remove the existing storm drain from the subject property.
Responsibilities of the City:
• Provide survey and title search for the property to be deeded to the City.
• Provide construction plans and details as necessary for construction of the new storm drain in
a timely manner so as to not adversely impact the development schedule.
• Reimburse you for the cost of construction of the new storm drain.

Dear Ms. Glatthorn:
The following revisions to the plan have been performed in response to comments we
received at the DRC of December 10, 1998:
1. Added a stop sign and stop bar at the access points on David Avenue and Gulf-
To-Bay Blvd.
2. Added a 4' sidewalk on David Avenue.
3. Delineated 5' buffer on east and west property lines.
4. Noted that the site was previously developed as a 13 room motel with 4875 sf.
5. Revised dumpster width to 12' and added bollards. Also noted to be enclosed.
The developer has agreed to stucco the outside and paint to match the building.
6. Provided separate tap for irrigation meter.
7. Added spillway to the retention pond 1.
8. Revised site by moving northern most parking panel 9' south to comply with
restriction on development outside of commercial zoning.
9. Added two additional islands to meet interior landscape requirements.
10. Revised landscape plan per revised layout and comments by Mr. Mark Parry.
