DATE: January 6, 1988 r3l? << The Development Review Committee at its meeting of October 22, 1987 and December 10, 1987 approved the above described final site plan subject to the following conditions:. 1. The data section pertaining to coverage of development must be amended to reflect a unit count of 275, and a nursing bed count of 55, rather than 330 units. (Has been amended) 2. The required parking for the site must be restated to reflect the number of units, the number of nursing beds and the number of employees, as is shown on the original plan. (Proposed parking count has been increased from the original plan.) 3. The dumpster shown on the ortion of the site must be screened with a 12, wide clear opening and placedin such a manner so as to provide for pick-up by Sanitation. (Subject to approval by the Utilities Dept.) 4. DER and SWFMMD permits must be provided to the Public Works Department prior to the issuance of a building permit. 5. Calculations showing that existing retention ponds are adequate to service the remaining phases of this project must be provided to the Public Works Department prior to the issuance the building permit. 6. A 10' easement must be provided over all existing and proposed water lines up to and including meters and hydrants prior to the issuance of a building permit. 7. Ingress/egress easements must be provided prior to the issuance of a build- ing permit. 8. The O.R. Book and Page number for the right-of-way dedication for McMullen- Booth Road must be shown on the final plan. (Shown on the final plan.) 9. The existing fire hydrant along the north property line must be relocated as required by the Utilities ,Department. (Subject to approval by the Utilities Department.) 10. The site plan must reflect that there will be a 10' property transfer to the City of elan along the north side of the project, such transfer to occur prior to the issuance of the building permit. 114 The sidewalk as shown on the plan proposed along the north side of the project may not be installed and must be removed from. the site plan. (Has been removed from.the site plan.) 12. The requisite initial building permit must be procured within six (6) months from the date of certification of the final plan and all certificates of occupancy must be obtained within three (3) years of the date of certifica- tion of the final plan. Dimensional and Numerical Development Requirements. Family, ¦ group and congregate care facilities shall be governed by the dimensional and numerical development requirements contained h r i ft e e na er: 1. Family care facilities shall be treated as a single family dwelling for the purpose of determining applicable dimensional and numerical development requirements and, therefore, shall conform to the requirements identified for a single family dwelling in the zoning district assigned to the property. 2. Group care facilities shall be governed by the dimen- sional and numerical development requirements identified in the zoning district assigned to the property and the following: a. A minimum habitable floor area of one thousand, six hundred (1,600) square feet shall be provided for any such facility which houses six (6) persons. Those facilities which house more than six (6) persons shall be provided with a minimum habitable floor area of one thousand, six hundred (1,600) square feet plus two hundred (200) square feet per additional resi- dent. _ b. -A minimum lot area of six thousand (6,000) square feet Shall be provided for any such facility which houses six (6) persons. Those facilities which house more than six (6) persons shall be provided with a minimum lot area of six thousand (6,000) square feet plus one thousand, five hundred (1,500) square feet per additional resident. 3. Congregate care facilities shall be governed by the dimensional and numerical development requirements identified in the zoning district assigned to the property. For the purpose of administering the density provisions, no bonuses or other allowances shall be permitted for units without kitchen facilities. 136-45. Lau.l Devela10 k CsWe F. Separation. No family or group care facility shall be located within a radius of one thousand, two hundred (1,200) feet of another family or group care facility, as measured along a straight line connecting the periphery of the proper- ties at the closest points. The purpose of this separation criterion is to further the objective of deinstitutionaliza- tion by preserving a normal residential environment and thus to avoid the undue concentration of such facilities that would adversely impact an individual neighborhood and ultimately defeat the end objective of providing for such special living facilities. G. Accessory Uses. Accessory uses shall be limited to those normal and incidental to residential dwelling units, except that nursing homes licensed under Chapter 10A-5, Florida Administrative Code, may be permitted as an accessory use to a congregate care facility with .a maximum number of beds that represent not more than twenty (20) percent of the total number of dwelling uni.ts in the facility. Nursing homes. permitted as such accessory use shall be considered sheltered nursing homes that are designed for the exclusive use of the residents of the congregate care facility and not the general public, except for an initial period of two (2) years from the date a certificate of occupancy/use is issued during which period-such nursing home may be open to the public. Any person other than a resident of the congregate care facility admitted to the nursing home during the initial two-year period may continue to occupy such facility indefi- nitely, but no person shall be admitted after such two-year period except as shall be a bonafide resident of the congre- gate care facility. Nursing homes with a bed capacity in excess of twenty (20) percent of the number of dwelling units will be permitted only in those zoning districts which other- wise permit nursing homes and shall for.the purpose of permitting and computing density be treated as a principal use of the land. 136-46.
