I, the undersigned, Sybil W. Martin, do hereby attest that I am the widow of Carley C. Yates, deceased,
who is buried in the Clearwater Municipal Cemetery in Clearwater, Florida. I grant right of interment to Ruby Jean
Yates' cremated remains in the cemetery property formerly owned by Carley C. Yates described as Block 4, Lot
11, at the foot of Space 4, Clearwater Cemetery which has been reserved for use by me.
I further agree to release, indemnify and hold the City of Clearwater harmless from liability in the event
of any claim arising from the use of the above described property for the interment of Ruby Jean Yates' cremated
remains.

she preferred to call rather than write because writing was difficult for her in
her present state of health (her hands shake) She went on to state that when she
gave the papers to Mr. Rudolph of Moss Funeral Home "there was no question about
where to bury her mother".

I called Moss Dunedin - no papers in files - was referred to Ft. Harrison - files
did not have anything in them pertaining to property ownership.

Phone call conversation with Mr. Yates (AC615 824-8083). I told him that Mrs.
Grumbling's daughter was responsive to our letter. I stated "she gave some
papers to Mr. Rudolph, etc.". I also state she had nothing else. I told Mr.
Yates that Moss had nothing on file. He agreed to be patient whale we fin out,
what we can and cannot do. Wants us to call when we know.

Dear Mr. Yates:
We have researched, extensively, the situation regarding Mrs. Minnie
'Grumbling and her husband, Dr. P.W. Rowley, being placed in a space which you
believe to be a cemetery plot owned by your father, C.C. Yates.
Unfortunately, the beginnings of this circumstance were in a time where
we have few reliable records. According to Ms. Andrew, Mrs. Grumbling's
daughter, your father allowed Mrs. Grumbling to purchase a portion of his lot
in 1948 (please see enclosed letter). The monument referenced in Ms. Andrew's
letter is in the southern-most of the spaces originally purchased by your father.
Mrs. Grumbling and her husband are in the space immediately north of the monument
space. We have no reason to doubt that Mrs. Grumbling had permission to use
these spaces as the monument has been in place since 1948, Dr. Rowley's cremated
remains have been in the adjacent space since 1959, and there has been no
question regarding this. Your father was interred in 1964.
As to reserving a space for your ex-wife, the northern-most space is
vacant. Assuming your mother has authority as beneficiary of your father's
estate, she could provide us with directions regarding reserving that northern-
most space for your ex-wife. We would need some proof of that authority.
The other vacant space, just north of the space in which your father is
interred, has been reserved for your mother, Sybil Yates.

site in the above cemetery.
You responded to us with a phone call on April 18 in which you indicated
you had given some papers to Mr. Rudolph, the funeral director. We have
contacted Moss Funeral Home in Dunedin and they have no papers regarding the
cemetery space in their files.
We would appreciate it if you would confirm your response to our
previous letter in writing and provide us with any additional information you
might have in this regard.

On August 4, 1983, your mother Mrs. Minnie Grumbling, was buried at the
above cemetery in Block 4, west 1/2 of Lot 11, second space from the south.
At that time, you indicated that you had some proof of ownership which
you would furnish to the City.
Recently, we have had an inquiry regarding the number of spaces still
available in this lot. The party inquiring has two separate deeds indicating
ownership.
It is imperative that you send us a copy of the information you have as
it was apparently never received by the City.
