DEDICATlOO AGREEMfNI' FOR ROAD RIGHT OF WAY
THIS AGREEMENT is entered into as of this ~ dcry of S-6?JOTte4J/Mr ,
1979, by and between u.S. Hare Col:pOration, a Delaware corporation ("Hare")
and The City of Clearwater, a Florida nu.micipal cOl:poration, whose mailing
address is 112 S. Osceola Avenue, Clearwater, Florida, 33516 ("City").
WHEREAS, in oonnection with its developIent of real property in Pine lIas
Coutlty, Florida, Hone has oonstructed certain road inprovenents and drainage
and other facilities; and
WHEREAS, Hare is willing to exmvey sudl rights-of-way, road improvenents
and facilities to the City for public use provided the City agrees to
accept sudl roads and facilities for maintenance;
NOW, THEREFORE, in oonsideration of the above premises, Ten Ibllars
($10.00) and other good and valuable consideration, the receipt and
sufficiency of whidl is hereby acknowledged, the parties rereto do mutually
agree as follows:
1. Home hereby grants, bargains, and sells to the City the real
property described on Exhibit A attadled hereto and inooIporated herein
by reference (the "Property") for use as a public road right-of-wcry and
for drainage and utility pw:poses.
2. By its joinder in the executicn of this Agree.nent, the City hereby
agrees to accept for maintenance the rights-of-wcry, road improvements oon-
sti tuting the Property and the drain~e, water and sewer facilities located in,
en and under the Property.
