Personally appeared before me, the undersigned authority,
HERBER T M. BROWN, who being duly sworn, made oath and said:
That he is and has been well acquainted with Simon Marks and
Fannie Mary Marks, his wife, the Grantees in that certain Deed from
Evelyn Gladys Boardman Jenkins, joined by her husband, Thomas M.
Jenkins, filed March 30, 1945 and recorded in Deed Book 1005, page
579 of the Public Records of Pinellas County, Florida; also that the said
Fannie Mary Marks is one and the same person as Fannie M. Marks, one
of the Grantors in that certain Deed filed January 14, 1957, and recorded
in OR Book 16, page 345 of the Public Records of Pinellas County, Florida.
Affiant further sayeth that he has known the said Fannie M. Marks,
also known as Fannie Mary Marks, for many years andspecifically prior
to and since March 26, 1945.

REAL ESTATE CONTRACT
THIS AGREEMENT, made and entered into this the 10th
day of September, 1956, between and among FANNIE MARY MARKS
and SIMON MARKS, her husband, hereinafter called "Sellers",
and CITX.9F CLEARWATER, a municipal corporation, hereinafter
called "Purchaser".

That in consideration of the mutual promises and coven-
ants herein contained, and other valuable considerations pass-
ing between the parties hereto, the Sellers agree to sell and
the Purchaser agrees to buy the following described property
situate, lying and being in Pinellas County, Florida:
Lots 3 and 4 in Block 52 of MANDALAY SUBDIVISION,
according to the map or plat thereof as recorded
in Plat Book 14, at Pages 32-35 inclusive of the
Public Records of Pinellas County, Florida.
upon the following terms and conditions:
1. The total purchase price of said property shall be
sum of Eleven Thousand Dollars ($11,000.00), payable in cash
on or before IJaJ1ua'.r,y.: 15, 195r?
2. The property shall be conveyed by Warranty Deed and
shall be free and clear of all encumbrances whatsoever except
liens and charges for groins and bulkheads currently being in-
stalled by the City of Clearwater on said premises.
3. Powsess~on will be given at the time of closing, pro-
vided only that Purchaser shall have the right to go upon said

thereon and to the westward thereof.
4. Purchaser agrees to pay real estate taxes for the
year 1956 and agrees to place documentary stamps on theDeed.
5. The loss or damage to the premises by fire or other

6. Time is the essence of this agreement and all covenants
