regarding a parcel in SUNNY PARK GROVES deeded to the City in
error.
The deed is made pursuant to Alan Zimmet's 9-20-94 memorandum to
Cindy Goudeau regarding the matter (copy attached).

Property Deeded to City by County in Error
You have requested advice as to what procedure the City should follow to
reconvey a small 3' x 100' parcel ofland that the County deeded to the City on August 16, 1994
in error. It is our understanding that the County mistakenly thought the piece of property was
within the City's boundaries and consequently transferred that property to the City. Subsequent
to the transfer, the County realized that the above-referenced property was not within the City
and has therefore requested that the City reconvey the property to the County. We believe that
this property can be reconveyed to the County by use of a quit-claim deed as simply a corrective
measure. This is not a sale or exchange requiring the declaration of surplus property, nor do we
feel the transfer requires a referendum of the people since it is a corrective transfer between
governmental entities. We recommend therefore that the City merely reconvey the property to
the County by quit claim deed to correct the original error.
We trust this answers your questions with respect to the subject matter but if you
