Boffer, a are the owners of the following real property situate, lying and being in the County of Pinellas and State of Florida, to wit: Lots 2, 3, 4, 5, 6, 8, 9, 10, 11, 18, 19, 20, 21, 22, 23, and 24, Block C, Carolina Terrace, according to map or plat thereof as recorded in Plat Book 12, page 15 of the Public Records of Pinellas County, Florida; and WHEREAS, said Owners desire to place certain restrictions upon said property, which shall be covenants running with the land, for the pro... tection of themselves, persons and corporations purchasing said property from them or their heirs, executors or assigns, and the City of Clearwater, Florida, a municipal corporation; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that in consideration of the foregoing premises and other good and valuable consideration between the parties, receipt of which is hereby acknowledged, the undersigned, Kooiman Realty, Inc., a Florida corporation; McPherson Plecker and Nancy Plecker, his wife; and Clara C. Boffer, a , as owners of the above described real property, do hereby adopt and promulgate the restrictive covenants hereinafter set forth: 1. These restrictions and limitations are to be regarded as covenants running with the land regardless of whether they are specifically mentioned in any deeds or conveyances subsequently executed. 2. All buildings constructed hereon shall have a twenty foot (20') building setback from Michigan Avenue. 3. All buildings and structures constructed hereon shall be limited to a maximum height of two (2) stories. 4. In the development of said real property, there shall be constructed a solid screen by fence abutting Lots 1 and 17, Block C, of said Carolina Terrace. 5. The development of said real property shall be in accordance with the Site Plan now on file in the office of the City Clerk of the City of Clearwater. 6. These covenants and restrictions shall be binding on all parties and all persons claiming under them, and no exception, variation or termination of these restrictions shall be authorized or effective without the prior written consent of the City of Clearwater.
