CJ"J 2. The Owners have constructed upon the subject property certain buildings divided into rental-storage units. The present building plans on file with the City of Clearwater call for four (4) permanent toilet-sink combinations to be installed at the time that the building is constructed and seven (7) toilet-sink combinations to be roughed in in the event they are later required by the building or zoning regulations of the City of Clearwater if the rental-storage units are eventually used for light manufacturing purpos es. 3. The City of Clearwater has agreed to require only the installation of the four (4) permanent toilet-sink combinations during the initial construction phase and has required only the payment of the appropriate tap fees and impact fees now current and in force in the City of Clearwater as of the time of the initial construction. ~. !') 4. The Owners covenant and agree that if, in the future, it 1S required by the zoning and building regulations of the City of Clearwater for any reas on to install all or any portion of the remaining seven (7) toilet-sink combinations, the then owners of the property f'i will pay the then appropriate and applicable tap or impact fees to the City of Clearwater for the facilities so installed. -1- o .... z a::: ::l t; It: J5-oln-3 1"'-_ . -~ '. If at any time the City requires the Owners to install all or any portion of the remaining seven (7) toilet-sink combinations, then it shall furnish written notice upon the then Owners requiring that the work shall be completed within thirty (30) days from the receipt of such notice. If the Owners fail to comply with said written notice within said thirty (30) day period, then the City may take any appropriate legal action necessary to enforce the terms and conditions of this Covenant and the Owners shall pay all costs of such action, including a reasonable attorneyts fee. 6. It is intended that the representations of the Owners as set forth hereinabove shall constitute a covenant running with the land and said covenant shall be binding upon the grantor herein and any succes s or in interest to the pres ent Owners.
