1976, by and between the CITY OF CLEARWATER, FLORIDA, a municipal
corporation, Party of the First Part,and MARY L. CLARK, a si ngle woman,
of the Ci ty of Baltimore, State of Maryland, and MARCUS C. JOHNSON
and WI LLI E PEARL JOHNSON, his wi! e, of the Ci ty of Clearwater, County
of Pi nell as, and State of Florida, Parti es of the Second Part, whose
mai 1 i ng addres s is: c/o Post Office Box 1878, Cl earwater, Florida, 33517.
WI TNESSETH:
WHEREAS, the said Marcus C. Johnson and Wi lli e Pearl Johnson,
hi s wi fe, are the owners of the. foll owi ng descri bed property situated in
Pinell as County, Florida, to-wit:
Lots 1 and 2, ALFRED ENNIS SUBDI VISION,
Plat Book 19, Page 75, Public Records of Pinellas
County, Florida; and
WHER EAS, the said property was conveyed to Marcus C,
Johnson and Willie Pearl Johnson, hi s wife, by Deed dated January 16, 1974,
and filed on said date as instrument number 74007512, in the office of the Clerk
of the Circuit Court in and for Pinellas County, Florida, containing the
following restriction:
"Grantee shall obtain a building permit within forty (40)
months from the date hereof and commence construction
immediately thereafter or the property will revert to the
Grantor herein. I' And,
WHEREAS, the City of Clearwater was the Grantor in the said
document, and upon request of the said Parties of the Second Part, which came
on before the regularly scheduled City Commission meeting for the City of
Clearwater on Thursday, May 21, 1976, the said City of Clearwater has agreed
to extend the reverter clause for an additional forty (40) months upon the same
terms and conditions as originally granted to the said Marcus C. Johnson and
Willie Pearl Johnson, his wife. It is, therefore,
AGREED, for and in consideration of the sum of Ten ($10.00) Dollars
and other good and-,valuable considerations to it in hand paid by the said Parties

1. Mary L. Clark, a single woman, Purchaser of the following
described property lying and being in the County of Pinellas and State of
Florida, to-wit:
Lots 1 and 2, ALFRED ENNIS SUBDIVISION, Plat Book
19, Page 75, Public Records of Pinellas County, Florida.
shall receive said property subject to the following right of reverter in and
to the said City of Clearwater, as follows:
That certain restriction contained in that Deed dated
January 16, 1974, from the City of Clearwater, a
municipal corporation, to Marcus C. Johnson and
Willie Pearl Johnson, his wife, and duly filed for
recOrd January 16, 1974, as instrument number
74007512, in the Office of the Clerk of the Circuit
Court in and for Pinellas County, Florida, shall be,
and the same hereby is, extended for an additional
forty (40) months upon the condition that Mary L.
Clark, a single woman, Grantee from Marcus C.
Johnson and Willie Pearl Johnson, his wife, in a
Deed recorded of even date herewith, shall obtain a
building permit for construction on the said premises
within the time period stated and shall thereafter
commence construction immediately, or the property
will revert to the City of Clearwater, a municipal
corporation.
IN WITNESS WHEREOF, said Party of the First Part has caused
these presents to be executed in its name by its City Manager, City Clerk,
countersigned by its Mayor-Commissioner, and approved as to form and
correctness by its City Attorney, and its corporate seal to be herejJrltoattached,
