Pursuant to your request I have examined the Declaration of Unity of Title with lakeview
Baptist Church regarding their request to release lot 111 from the Declaration of Unity
of Title, The recorded Declaration of Unity of Title authorizes the City Manager to
release any property from said Unity of Title, I requested and opinion from Alan V,
Mahan, Coordinator/Central Permitting, as to the release of this property and the effect
it may have on the lakeview Baptist Church site, I have attached the memo from Alan
V, Mahan dated May 3D, 1996, wherein the Central Permitting Department concurs in
the action to remove the Unity of Title linking lot 111 from the lakeview Baptist Church
site,
As a result I have prepared the attached Partial Release of Declaration of Unity of Title
for signature, Please sign the enclosed document and forward to the City Clerk's Office
for signature and recording,

111 (Your memo, May 23, 1996)
Per your subject memo, we have determined from an examination of the site data relating to
the Lakeview Baptist property and Lot 111 of the Ardmore Replat, that the request to release
the Unity of Title binding the two properties together can be released with impunity. lot 111
was not included in the lot coverage for the church nor was the loning on the subject lot
changed from RS~8.
Accordingly, the Central Permitting Department concurs in the action to remove the Unity of
Title linking Lot 111 with the Lakeview Baptist Church site. As the action to impose and file
the unity of title was administrative in nature, it appears that action to remove the unity of
title may be approved at the City Manager level without the necessity to obtain City
Commission approval unless there are contravening policies/requirements of which we are
unaware,
