RECOM MENDATION: Upon the recommendation of the City Manager, the request of Mr. & Mrs. Marcus Johnson, regarding the sale of Lots 1 & 2, Alfred Ennis Subdivision, to MaryL. Clark, for $5, 100, be approved, subject to a reverter clause prepared by the City Attorney's office, giving Mary L. Clark 40 months from the date of purchase to obtain . a building permit, etc., as required in previous sales of this property. ctAnd that the appropriate officials be authorized to execute same. BACKGROUND: Please observe the attached real estate contract and letter from Mr. J. Paul Raymond, Attorney for Mary L. Clark. As stated by Mr. Raymond, the City sold this property to Mr. & Mrs. Johnson for $5, 100. The deed conveying the property to the Johnsons was dated January 16, 1974, and contained a stipulation that if a building permit was not obtained within forty (40) months from the date of sale and construction commenced inunediately thereafter, the property would revert to the City. On December 18, 1975, the City Commission approved that the City refund to the Johnsons the $5, 100 paid for the property, in exchange for a Quit Claim Deed for the property. This approval was subject to there being a bonafide buyer for the property from the City at the price of $6,000, and that the Deed conveying the property to the new own.ers contain the same reverter clause as the previous deed. The above action was taken by the City as the Johnsons believed they had the property sold for $6.000. Johnson and Willie Pearl Johnson, his wife Dear Mr. Weimer: As your files will reflect, the above-referenced property was sold to Mr. and Mrs. Johnson on or about January 16, 1974. The City of Clearwater placed a 40-month reverter clause in the deed conveying the property, which would be effective if a building permit was not issued within the time period. Thereafter, Mr. and Mrs. Johnson, realizing they could not afford construction, attempted to sell the property. As you will note, in December of this past year, they requested the City to approve a transfer, and to extend the reverter clause an additional 40 months from the date of transfer. This was done, but it was done at a time when the Johnsons felt they had the property sold for $6,000.00. This sale did not materialize. There now exists an offer on the Johnson property in the amount of $5,100.00, a photocopy of the executed contract, dated April 29, 1976. being enclosed for your files. I would like to request that the City review this contract, that it be approved and that the City grant Mary L. Clark, a single woman, an additional 40-months froIYl the date of transfer, just as the City did with Mr. and Mrs. Johnson. You will note that the contract is conditioned upon the City's approval in this regard, and that we have until June 30, 1976, so I would like to request that you advise me of the appropriate action necessary to bring this matter before the City for review and approval. JOHNSON and WILLIE PEARL JOHNSON, his wife, hereinafter referred to as "Se 11 er" and MARY L. CLARK, a sing 1 e woman, here i nafter referred to as "Purchaser". WIT N E SSE T H : That in consideration of the mutual promises and covenants herein contained, and other valuable considerations passing between the parties hereto, the Seller agrees to sell and the Purchaser agrees to buy the following described property situate, lying and being in Pinellas County, State of Florida, to-wit: Lots 1 and 2 of ALFRED ENNIS SUBDIVISION, Plat Book 19, Page 75, Public Records of Pinellas County, Florida. Purchase Price. The total purchase price of said property shall be the sum of $5,100.00 payable at the times and in the manner following: A. $500.00 upon the execution of this agreement. Said deposit will apply against the purchase price. Said deposit to be held by McMullen, Everett, Logan, Marquardt & Cl ine, P.A., pending closing. B. $4,600.00 cash or certified check at closing. Conveyance. The Seller promises to convey to the Purchaser by good and sufficient Warranty Deed containing full covenants of warranty a fee simple, marketable title to the real estate above described, free and clear of all encumbrances whatsoever, except as herein otherwise provided. Title Insurance. The Seller agrees to deliver to the Purchaser, within thirty (30) days of the date of this agreement, a commitment for title insurance in the amount of the purchase price, which commitment shall show a marketable, unencumbered, fee simple title to said property in the Seller except as herein otherwise provided. The Purchaser shall have five (5) days after the delivery of said commitment for the examination thereof, and within said period shall notify the Seller in writing of any objections to said title. If this notification is not given within a said period of time, then said title shall be conclusively deemed to be acceptable to the Purchaser.
