QUIT-CLAIM DEED
THIS INDENTURE, made this ~ day of

by and among JOSEPH S. SCHWARTZ and SHERRY F. SCHWARTZ, husband and wife,
and HARRY S. WILKS and GOLDIE WILKS, husband and wife, (1I0wnersll) and
CITY OF CLEARWATER, FLORIDA, a Municipal Corporation (IIClearwaterll).
STATEMENT OF FACT
1. Owners are the record title holders of a certain parcel of l~nd
(the IIPremisesll) situated at the corners of Pinellas Avenue, Greenwood Avenue,
and Tuskawilla Avenue, in the City of Clearwater, Florida, more particularly
described as follows:
Lots 4 thru 10, inclusive, of Block 13, of the
Subdivision of Blocks 13 and 19, of MILTON PARK,
as recorded in Plat Book 10, page 28 of the
Public Records of Pinellas County, Florida.
2. By Agreement dated May 13, 1983 and recorded in Official Records
Book 5542, page 141, of the Public Records of Pinellas County, Florida, (the
IIAgreementll), Owners granted to Clearwater a drainage easement in the location
and on the terms contained therein in substitution for an existing drainage
ditch used by Clearwater and running through the Premises.
3. Pursuant to Paragraph 1 of the Agreement, Clearwater agreed, upon
completion of construction of improvements by Owners, to release and quit-claim
to Owners any right, title and interest which it or the public might have to
conduct storm water drainage or water or sewer pipes or facilities through the
Premises other than as set forth in the Agreement.
4. By Certificate of Occupancy dated April 27, 1984, Clearwater
certified construction of the improvements in accordance with the Agreement.
5. Owners have now requested and Clearwater is willing by this
instrument to release certain rights and easements which it or the public
might have as required by the Agreement.

QUIT-CLAIM AND RELEASE
NOW, THEREFORE, for good and valuable consideration, the receipt
and sufficiency of which is hereby acknowledged, and in consideration of
the construction of relocated drainage facilities and grant of a relocated
drainage easement by Owners, Clearwater hereby releases, quit-claims and
reg rants unto the Owners any and all rights and easements which Clearwater,
or the public, may have to conduct storm water drainage or any other water
or sewer pipes or facilities through any portion of the Premises, excepting
such rights as are particularly granted to Clearwater by Drainage Easement
Agreement dated May 13, 1983 and recorded in Official Records Book 5542,
Page 141, of the Public Records of Pinellas County, Florida.
IN WITNESS WHEREOF, Clearwater has caused this instrument to be duly
executed on the day and year first above written.
