AGREEMENT
THIS AGREEMENT made this 23rd day of August ,
1991 by and between George L. Mallory , hereinafter
referred to as "Owner" and the City of Clearwater, a Municipal
Corporation, hereinafter referred to as the "City".
WIT N E SSE T H:
WHEREAS, Owner is developing a parking lot on properties
situate in the City of Clearwater, County of Pinellas, State of
Florida, being more fully described as follows, to-wit:
Lots 14-17 and that part of Lots 12 and 13 lying
southeast of Tampa and Gulf Coast Railroad Right-
of-Way, Block 15, MAP OF BELLEAIR, according to
map or plat thereof as recorded in Plat Book 1,
Page 105, public records of Hillsborough County,
Florida, of which Pinellas County formerly was a
part.
AND WHEREAS, said parking facility is being developed to
provide parking for other properties in the same general area
owned, managed or controlled by Owner, which are set forth on the
attached Exhibit IIA", and
WHEREAS the City has requested a commitment that Owner
will not utilize said properties as a commercial parking lot,
which is agreeable to Owner, it is
AGREED that for the sum of Ten Dollars and other valu-
able consideration, receipt of which is hereby acknowledged by
each of the parties hereto, as follows:
1. The recitals set forth above are true and correct,
and are incorporated herein by reference.
2. Absent further agreement of the City, Owner repre-
sents that the subj ect properties will not be utilized as a
commercial parking lot, as that term may be defined in the codes
in and for the City of Clearwater. Owner represents that the
properties will be utilized as extra or excess parking for the
properties described on the attached Exhibit "A".
3. Owner expressly reserves the right to remove the
parking lot in whole or in part at any time and from time to time
and to develop said properties in accordance with codes and
regulations then in existence, whereupon this restriction on the
use of the property, precluding its operation as a commercial
parking lot, shall be null, void and of no further force and
effect.
