WHEREAS, Herbert C. Schwartz and Cecelia S. Schwartz, his wife,
and Sandra A. Fisher, joined by Frederick E. Fisher, her husband, are the
owners of the following real property situate, lying and being in the County of
Pinellas and State of Florida, to wit:
From the East qua~r corner of Section 19, Township
29 South, Range 16 East, run North 89029113" West
along the East-West centerline of said Section 19, 600
feet for a P. O. B.; thence continue North 89029' 13" West,
509. 62 feet to a point on the Easterly right-of-way line
of that certain parcel of land owned by Florida Power
Corporation as described in O. R. Book 1416, page 182,
Public Records of Pinellas County, Florida (said point
being 223. 11 feet Easterly of the SW corner of the SE
1/4 of the NE 1/4 of said Section 19); run thence North
OP08'25" East along the East line of said right-of-way,
353.83 feet; run thence North 01012'20" East, 18.33 feet
to a point on the Southerly right-of-way line of Harn
Boulevard (see deed to the City of Clearwater as recorded
in O. R. Book 2582, page 417, Public Records of Pinellas
County, Florida); run thence South 58045129" East along the
South right-of-way line of Harn Boulevard, 110.90 feet;
thence run Southeasterly along a curve to the left of 395 foot
radius (chord bearing South 74007'211' East, chord distance
209.32 feet), 211.85 feet; thence run South 89029' 13" East,
209.99 feet; run thence South 00052'25" West, 260 feet
to the P.O.B.;

WHEREAS, said Owners desire to place certain restrictions upon
said property, which shall be covenants running with the land, for the pro-
tection of themselves, persons and corporations purchasing said property
from them or their heirs, executors or assigns, and the City of Clearwater,
Florida, a municipal corporation;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that in
consideration of the foregoing premises and other good and valuable con-
sideration between the parties, receipt of which is hereby acknowledged, the
undersigned, Herbert C. Schwartz and Cecelia S. Schwartz, his wife, and
Sandra A. Fisher, joined by Frederick E. Fisher, her husband, as owners
of the above described property, do hereby adopt and promulgate the restrictive
covenants hereinafter set forth:
1. These restrictions and linritations are to be regarded as covenants
running with the land regardless of whether they are specifically mentioned
in any deeds or conveyances subsequently executed.
2. The apartment project to be constructed on the above described tract
shall consist of one-bedroom apartment units only and shall be limited in height
to two (2) stories.
3. These covenants and restrictions shall be binding on all parties
and all persons claiming under them, and no exception, variation, or termination
of these restrictions shall be authorized or effective without the prior written
consent of the City of Clearwater.
