RESTRICTIONS
WHEREAS, HERMAN BAILEY, JR., RONALD FRANK, H. BENNETT,
and G. W. JOHNSON
as Trustees of Trinity Baptist Church, Clearwater, Florida, are the
Owners of the following real property situate, lying and being in
the County of Pinellas and State of Florida, to wit:
Lots 194 through 208, inclusive, Morningside Estates,
Unit 1, according to the map or plat thereof as
recorded in Plat Book 59r pages 58 and 59 of the
Public Records of Pinellas County, Florida~
and
WHEREAS, said Owners desire to place certain restrictions
upon said property, which shall be covenants running with the land,
for the protection of themselves, persons and corporations purchasing
said property from them or their heirs, executors, successors or
assigns, and the City of Clearwater, Florida, a municipal corporation~
NOW, THEREFORE r KNOW ALL MEN BY THESE PRESENTS, 'chat in
consideration of the foregoing premises and other good and valuable
consideration between the parties, receipt of which is hereby
acknowledged, the undersigned,
as Trustees of Trinity Baptist Church, Clearwater, Florida, as Owners
of the above described real property, do hereby adopt and promulgate
the restrictive covenants hereinafter set forth:
1. These restrictions and limitations are to be regarded
as covenants running with the land regardless of whether they are
specifically mentioned in any deeds or conveyances subsequently
executed.
2. The development of this property shall not include any
residential use and all structures constructed thereon shall be
limited to thirty-five feet (35') in height.
3. All parking areas and beautification shall conform to
parking requirements as set out in PS (Professional Services) zoning
and subject to review and approval by the City Traffic Engineer.
4. All signs erected thereon shall conform to professional
use limitations as set out in the City of Clearwater sign ordinance
and regulations.
5. There shall be no through traffic access onto Claiborne
Drive from Belcher Street across said real property.
6. These covenants and restrictions shall be binding on all
parties and all persons claiming under them, and no exception,
variation or termination of these restrictions shall be authorized
or effective without the prior written consent of the City of
Clearwater.
