S. 19 South is presently owned by Forrest Garrison; and WHEREAS, the City Commission of the City of Clearwater at its meeting held May 20, 1976, approved a revised plan submitted for Far Horizons Mobile Home Park, provided that the entrance and exit on Nursery Road be approved by the Traffic Engineer, that a suitable barrier be retained between the Park and the commercial area and provided further that a substantial number of the Park occupants agree to the change; and WHEREAS, the Owner in order to replace open space area that is lost is willing to designate and utilize Lots 5, 2, 1 and 17, all within the boundaries of Far Horizons Mobile Home Park for open space purposes when the lots are vacated; and WHEREAS, the Owner, Forrest Garrison, desires to make the use of Lots 5, 2, 1 and 17 a covenant which shall run with the land for the benefit and protection of the City of Clearwater, Florida, a municipal corporation, the Owner of said lots and all persons and corporations purchasing said property from him or his successors, assigns, heirs or personal representatives; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that in consideration of the foregoing premises and other good and valuable consideration between the parties, receip: of which is hereby acknowledged, the undersigned, Forrest Garrison, as Owner of the real property located at the intersection of Nursery Road and U. The following covenant and restriction is to be considered as running with the land regardless of whether it is specifically mentioned in any subsequent deed or conveyances of any or all of the following described real property: From the SE corner of the NE 1/4 of SE 1/4 of Section 19, Township 29 South, Range 16 East, run N 89024'27" W, 300. 01 feet; thence N 01026'21" E, 40. 00 feet to the P. O. B. ; thence N 89024'27" E, 802.72 feet; thence N 01008'24" E, 445. 55 feet; thence S 89025 '39" E, 835. 11 feet; thence S,OP26'21" W, 202. 92 feet; thence N 89024'27'1 W, 30.00 feet; thence S 01026'21" W, 243.00 feet to the P. O. B. 2. Forrest Garrison by and on behalf of himself, his successors and assigns, and on behalf of any subsequent owner of said real property, hereby specifically covenants and agrees as follows: (a) That Lots 5, 2, 1 and 17 of Far Horizons Mobile Home Park, which Park is located at the intersection of Nursery Road and U. S. 19 South, shall be converted to and remain devoted to open space and recreation as sociated with an open space use of land immediately upon these lots becoming vacant. 3. Owner Forrest Garrison covenants and agrees that the covenant contained in Paragraph 2 above may not be altered, amended or changed in any way without first obtaining the prior written consent and approval of the City Commission of the City of Clearwater, Florida. 4. It is specifically understood, covenanted and agreed that the foregoing covenant and re stricti on shall run with the above described real property and shall bind not only the present Owner, Forrest Garrison, but all of his successors and assigns whether they are specifically mentioned in any conveyance, deed or transfer of all or any of said described real property. 5.
