ELDERKIN, witnesseth that WHEREAS, the said co-executors are the owners of the fee simple title to the property hereinafter described, and WHERRAS, John D. Rlderkin is the purchaser under a certain written contract between said co-executors, as vendors, and said John D. Rlderkin, as purchaser, dated March 4, 1969, which contract has not yet been consummated, and WHERE'AS, said co-executors have filed their petition to be annexed to the City of Clearwater, NOW, THEREFCRE', in consideration of the sum of Ten Dollars, and other good and valuable considerations, receipt of which is acknowledged, the undersigned agree and covenant with the City of Clearwater that 1. Should the City of Clearwater hereafter determine to open and use the following described real property, located inPinellas County, Florida, to wit: The South Thirty Feet (S 30 ') of the Northwest Quarter (NW~) of the Southeast Quarter (SE~) of the Southwest Quarter (SW\) of Section Eighteen (18), Township Twenty-nine South (T 29 S), Range Sixteen East (R 16 EJ, I I G.R. 3140 PAGE 2~18 '. deed in recordable form conveying the above-described property to said City of Clearwater for such right-of-way purposes, without any further consideration or payment of any kind whatsoever from the City of Clearwater. 2. Should the said co-executors have conveyed the title to said above descr ibed property to said John D. ~lderkin at the time of any request or demand made by the City of Clearwater for such deed of conveyance, then said co-executors shall be excused from any further obligations of this covenant.
