AGREEMENT FOR PURCHASE
AND SALE OF RIGHT-OF-WAY
THIS AGREEMENT, made and entered into this

~d~ ' 1984, by and between HENRY L. MARION and
VIRGILINE M. MARION, his wife, hereinafter referred to as Sellers
and the CITY OF CLEARWATER, FLORIDA, a municipal corporation,
hereinafter referred to as Purchaser;
WIT N E SSE T H
That in consideration of the mutual promises and covenants
herein contained and other valuable considerations passing between
the parties hereto, the Sellers agree to sell and the Purchasers
agree to buy the following described real property situate, lying
and being in Pinellas County, Florida, for right-of-way purposes,
to wit:
The South 50.00 feet of the following described tract:
The East 592.78 feet of the Southeast 1/4 of the
Northeast 1/4 of the Southwest 1/4 and the South 996.31
feet of the West 333.00 feet of the Northwest 1/4 of the
Southeast 1/4 of Section 18, Township 29 South, Range 16 East.
The total purchase price of said property shall be the sum of
One Hundred and Twenty-Five Thousand Dollars ($125,000.00), payable
in full upon closing, which shall be on or before thirty (30) days
from date of approval by the Clearwater City Commission, at the
office of the City Attorney, Clearwater City Hall, 112 S. Osceola
Avenue, Clearwater, Florida.
IN CONSIDERATION WHEREOF, Sellers agree to convey said property
to said Purchaser by good and sufficient Warranty Deed, with fee
simple, marketable title, free and clear of all encumbrances of
record.
Purchaser agrees to pay all closing costs.
As part of this contract the Purchaser agrees to connect the
two sewer treatment plants to the City sewer system, without cost
to the Sellers. The connection will be made short of the treatment
plants with the Sellers insuring that the sewer lines are in a
satisfactory condition for making the connection.
Both parties agree that neither have used the services of a
real estate broker in this transaction and no brokerage fee is due
anyone.

The obligations and baEfits under this contract shall extend
to the personal representatives, heirs, successors and assigns of
the parties hereto.
IN WITNESS WHEREOF, the parties hereto have set their hands
and seals the day and year first above written.
