RE LEASE AND WAIVER OF USE COVENANT
LOT 12
CLEARWATER INDUSTRIAL PARK
WHEREAS, William B. Cox and Helen O. Cox, his wife, are
purchasing under contract the East 1-1/2 acres of Lot 11 of Clearwater
Industrial Park, as recorded in Plat Book 44, page 46 of the Public
Records of Pinellas County, Florida, having acquired same from the
City of Clearwater subject to certain protective covenants imposed on the
premises comprising the Clearwater Industrial Park as recorded in O. R.
115, pages 347-354, and by amendment recorded in O. R. 169, page 542,
Public Records of Pinellas County, Florida; and
WHEREAS, the aforesaid protective covenants, restricted the use of
any of the lots comprising the Clearwater Industrial Park to manufacturing,
industrial or storage purposes only; and
WHEREAS, the Upper Pinellas Association for Retarded Children desires
to acquire Lot 12 of said Clearwater Industrial Park and to construct thereon
and utilize said construction as an Habilitation Center for the purpose of pro-
viding vocational training directed towards placement of young adults and
adults in industrial occupations, maintaining an industrial contract shop,
a production work shop and related facilities not heretofore made available
to the retarded for the purpose of making those utilizing said facilities con-
tributing and productive members of the community, but is presently pro-
hibited in using Lot 12 for the purposes set forth above by virtue of the existing
use restrictions imposed on Lot 12; and
WHEREAS, William B. Cox and Helen O. Cox, his wife, have no
objection to the use of said Lot 12 for an Habilitation Center and for the
purposes above described; provided that should Lot 12 cease being used as
an Habilitation Center for the purposes aforesaid, then and in that event it
shall not be used for any purpose or use other than manufacturing, industrial
or storage.
NOW, THEREFORE, William B. Cox and Helen O. Cox, his wife, in
consideration of the sum of One Dollar ($1. 00) and other good and valuable con-
siderations, do hereby waive the use restrictions presently imposed on Lot 12,
Clearwater Industrial Park, and agree that it may be conveyed by the City of
Clearwater not subject to the pr esently existing use restrictions but so as to
authorize and permit its use as an Habilitation Center for the Retarded and
for all incidental purposes thereof. Said William B. Cox and Helen O. Cox,
his wife, further release and discharge the City of Clearwater from any and
all causes of action which it may hereafter have against said City occasioned
by its conveyance of Lot 12 for the use and purposes as set forth above.
