THIS DEED, made this / /rH-day of Ju L.-'-j ,2000 between PINEL LAS COUNTY,
FLORIDA, a political subdivision of the State of Florida, whose mailing address is 315 Court
Street, Clearwater, FL 33756, party of the first part, and CITY OF CLEARWATER, a
municipal corporation of the State of Florida, party ofthe second part, whose mailing address is
Post Office Box 4748, Clearwater, FL 33758-4748,
That the party of the first part, for and in consideration of the sum of $10,00 and other
good and valuable consideration to it in hand paid by the party of the second part, receipt
whereof is hereby acknowledged, has granted, bargained and sold to the party of the second part,
C' its heirs and assigns forever, the following described land lying and being in Pinellas County,
Florida:
As described in Exhibit "A" attached hereto and made a part hereof.
Subject to Easements and Restrictions of record,
Party of the second part agrees that the lands described above shall be used solely and
perpetually as a natural conservation area, with the exception of upland land not to exceed two
acres in extent, contiguous to the parking area at the westernmost edge of the property, as
described in attached Exhibit "A", Further, party of the second part, its successors and assigns
shall assume perpetual maintenance responsibility including, but not limited to, mowing,
removal of weeds and brush, maintenance of any detention/treatment ponds, overflow structures
and any fencing needed, monitoring of plant growth and all other maintenance in accordance
with State and Local permit requirements, Party of second part shall not permit or allow any
chemical aquatic vegetation inhibitor or weed killing agent within the confines of the ponds or
their immediate banks, except as may be necessary for control of exotic vegetation,
