WHEREAS, it has been requested by Jack A. Smith Properties,
Inc., the owner of Lota 3, 4, 5 and the South 1(2 of Lot 6 In Block 6
of Jones Subdivision of Nicholson Addition to Clearwater, that the City
of Clearwater, Florida, vacate that certain portion of the 16-foot alley
which is adjacent to the rear of its property; and
WHEREAS, said alley is not necessary nor required since the
eastern extremity of the alley terminates at the right of way of the Atlantic
Coast Line Railroad, and it is deemed to be to the best interest and
advantage of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED AS
FOLLOWS:
1. That the following described alley:
' That portion of the certain alley bounded by the Atlantic
Coast Line Railroad track on the East, lying North of Lots
3 and +4 and South of Lots 5 and 6, all of which are located
in Block 6 in Jones Subdivision of Nicholson Addition to
Clearwater, according to map or plat thereof as recorded
in Plat Book 1, page 13 of the Public Records of Hillsborough
County, Florida, of which Pinellas County was formerly
a part,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its night, title and
interest thereto to the persons, firms or corporations entitled thereto
by law, as abutting lot owners.
2. That a certified copy of this Resolution be furnished to Jack A.
Smith Properties, inc., PO Box 1679, Clearwater, Florida.
PASSED AND ADOPTED this 17th day of Septembgr, A. D. 1962.
