WHEREAS, the Pinellas County Board of Public Instruction has
requested the City of Clearwater, Florida to vacate Dempsey Street
from the West side of Pomelo Avenue West to the East line of the Sea-
board Air Line Railroad right of way; and
WHEREAS, said portion of Dempsey Street is not being used as
right of way and has in fact a building thereon; and
WHEREAS, it is deemed to be to the best interest and advantage of
the City and the general public that the same be vacated subject to reservag
a five foot easement in said right of way for utility purposes and subject
also to the condition that any movement of pipes shall be done at the
expense of the owner;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED AS
FOLLOWS:
1. That Dempsey Street from the West side of Pomelo Avenue'
West to the East line of the Seaboard Air Line Railroad right of way
be and the same is hereby vacated, closed and released, and the City
of Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms, governmental agencies or
corporations entitled thereto by law, as abutting lot owners, subject,
however, to reserving a five foot easement in said right of way for
utility purposes and subject also to the condition that any movement
of pipes shall be done at the expense of the owner.
