WHEREAS$ the Seaboard Air Line Railroad Company, under
date of June 22, 1960, has requested permission of the City
of Clearwater to construct a spur track in a City alley
crossing "Jill Street, and lying between the cast boundary
of Lots 7, 8 and 9, and the Test boundary of Lot 6, all is
block 16, of the map of belleair, Florida; and
WHEREAS, the City has indicated its agreement to co-
operate with said Seaboard Air Line Railroad Company, pro-
vided the City reserves unto itself ingress and egress over
and across said alley and/or easement and street and pro-
vided further that in the event said spur track Is abandoned
and ceases to be used, that said easement shall cease and
terminate; and
WHEREAS, the Railroad has requested that an Easement be
executed and a Resolution adopted by•the City, formally ap-
proving same and authorizing the execution thereof;
NOW, Thk2BFUHE, BE iT RFSULVED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, IN SESSION DULY AND REGULARLY
ASSEMBLED, AS FOLLOWS:
That the Mayor, together with the other appropriate muni-
cipal officers of the City of Clearwater, are hereby author-
ized and empowered to execute a certain Easement with the
Seaboard Air Line Railroad Company, bearing date the 5th
day of Jul t 1960, in connection with layi-g,maintain-
ing, operating an repairing a spur track in a City alley
crossing "D« Street and lying between the East boundary of
hots 7, 8-and 9, and the West boundary of Lot 6, all in Block
16 of the map of Bellsair, Florida, all being in the City of
Clearwater, Pinellas County, Florida.
