The solid wASte management system of tt�e city, which inc�udes refuse service anci recycling services, �re combined to form a unifed pu�ilic utility for the use and benefit of the city in the maintenance of publia health, welfare and s�nit�tian throu�hout the city. (2) Commercial establishment means a praperty or properties zoned or used for ��� commercial or industrial,uses, or used by an entity exempt from federal income taxation under section 501(c)(3) of the Intemal Revenue Code. The term eYCludes property or praperties zan�d or used far single-family residential or muitifamily � residential uses. (l0} Recovered materi�ls means metal, gaper, glass, plastic, texkile or rubber materials that have knawn recycling poter�tial, can be feasibly recycled, and havc bcen . dir+eried �nd saurce-separated or have been removed from the solid waste stream �O�' SAIC, �se, or reuse as raw mAterials, whether ar not the materials require subsequcnt processing or separation from each other, but dnes not include materials destined for any use that constitutes disposaL Recovereci materials are not solid waste. {11) Recovered materials dealer means any perso�i, who handles, purchases, receives, recovers, sells, or is �n end�user of recovered materials. (1�) Recaver�d m�terials processing facility means a facility engaged solely in the � storage, processing, resale ar reuse of recovered materials. SuCh a iacility is not a solid waste management facility if it meets the definitioz�s of section �03.7045{1}(�, Florida Statutes. (I3) Recyclable means those materials, which are capable o�being recycled and wkiich would otherwise be processed or disposed of as solid �vaste. {14) Recycling means th� collectinn, processing, marketing, repracessin� and resale or re�se of any material, wttich would otherwise be processed or dispased of as salid waste. � 15� Recvclin� bin means anv container issued bv the Citv far _ the purpose _ of rec. _cl�� (lbl Refijse means �llputrescible and non-putrescible solid.waste, l7 Residential ref�se cantainer mear�s a cit issued automAted container and/or a citv_approveci 32- �aj�on cont�incr or other cantainer approved b ty he Direckor of Salid Waste. The ter;n does not include recovered materials as . de�ined in this section or in sec�ian 403.703(7), Flarida Statutes. (19} Sa�id waste management men�ns the process by which solid waste is coltected, transported, stored, separated, processed or disposcd of accarding to an orderly, purposeful And planned program which inc�udes closure �nd lon�-tcrm maintenance. (20) Solid Wastc director means the person__authorized ta_ex�rcise and__enforce the provisions of this ordivance. (2I) Solid waste nzanagement facility means �ny solid waste disposal area, volume reduction piant, transfer stakion, matenals recovery facility or other facility, tiie purpose of which is resource recovery or the dispasa�, recyclin�, processing ar � stor�ge of solid waste. The term does not include recovered materials processing facilities which n�e�t th� requiremeryts af Section 403.7046(4), Florida Statutes, except the portion of such facilities, if any, that is used for the management of solid waste. (22) Source-separated means that recovered materials are separated from solid waste �`"� � wl�ere the recavered materials and solid waste are generated. The term does not �� require khat various types of recovered materials be sep�rated from each other and recognizes t�tat dc minimis solid waske, in accardance with ind�zstry standards and practices, may be included in the recovered materials. , (23) Special wasies means solid w�ste that can require specia� handlin� and management, including, but not limited to, white goods, waste tires, used oil, lead-acid batteries, construction and demolition debris, ash residue, yard trash and bialogical wastes. �24) Trash me�ns anv waste accumulation of paner, sweepin�sLra��beddin� or other matter af any kind, other than �arbage, which is usuallv attendant ta housekeeping, excen� recyclables. �,25) White �oods mean inonerative and discarded_refri�eratars,_ran�es, water heaters, freezer and other similar domestic and commercia! lar�e at�uiiances.of any color. �261 Yard Waste means ve�etative n�atter resultin� from landscaping aiid maintenance. All refuse �ecumulated in the city shal� be collected, conv�yed and disposed af by the city government. Follawing receipt and referr�l by thc City Commission ofannexation petitions, the city shall, upon request by the petitianers, collect refuse accumulated on properties being annexed by the city. {2} Exception for commercial cstablishments, Tl�is chapter shall not prnhiUit the actual producers af salid waste ar the owners of premiscs upan which solid wasts has accum�lated, from personal�y callectin�, con�eying and disposing af suc� solid waste provideci such producers or owners com�ly with the provisions ofthis chapter and with all other governing laws and ordinances. This para�raph shall nok be construed to pravide far or as allowing collectian by subcontract. An owner or prodacer o�refuse or recyclable materials may sell or donate these materials but may not �i�ter into any disposai agreement whereby the owner or praducer pays for the use of the container or for hauiing. (3) Exception for outside collectors. This chapter shall not prohibit solid waste collectors from outside of the city from hauling such solid w�ste aver city slreets prescribed by �'' the ditector of public warks provided such collectors comply witl� th� pravisians of ���� this cl�apter a�d ali ather governing iaws and ordinances, .� . � :�;.:� {4} Exception far private collectors with roll-aff containers. This chapter sha1� not prohibit a�rivate collector holding a permit issued by the city from piacing and servicing roll-offcontainers For commercial and industriai solid waste that the city does nat choose to collect and appruves for collection by outside contract. 5 Th� Cit has the ri ht to refuse arba e scrvice of an unusual or extremel �ulk item or to require the owner or producer of waste to reduce it to such size and v4rei�ht as can be handled bv Citv equipment. All solid wastc and recvc��bles accumulated in the city shall be collected, conveyed, and disposed af ar ouierwise managed by the city under the supervision of the director af �e��-solid �vaste. It is hereby declared uaiawful and a violakion aithis chapter far any person to do or pe�rmit to be done any of tf�e fallawing acts ar practices: {1) To deposit on ar bury in, or cause to be deposited in or buried in, any prope�ty, public or private, and any street, alley, the waters of Clearwater Bay, or any creelc, watercourse, storm sewer, or ditch within the carparate limits af t�e city, any solid waste or otli�r naxious, maIndorous or offensive matter; ,.,�M� . '' (2) To faiI or neglect to keep or cause to he kept clean and sanitaiy or tightly covered and in good state af repair a�! containers and trash rec�ptacles; (3) Ta place or aliow to be placed upon the streets, allcys, curbs, bicycle paths or sidewalks of the city any rubbis3�, swcepings, debris, trash or waste materials oF any �Cind, which constitutes a menace to traffic, bath vehicular arid pedestrian, or a health or aesthetic problem, or which impairs the proper operation of the city's sewer or drainage system; e� � To remave recyclables or any marketable materials from solid waste placed out for collection. Such an act is declared "scavenging" and is punishable by a fine of $Sa0,4U per incident. An incidcnt is deemed ta be the removal of such materials from a single premises; � fSl To dispase of�n�paint, hazardous material, acid, explosive material, inflammable liauids, burning_s_ubstance_ar_an_y dangerous_a_r_hi�Y corrosive material,_used ai1 or biohazardous wasies in anv refuse container which might be detrimenta! or harmful_to_an�person or nersons. Hi�hly inflamma_b_I_e �r potentiall�explosive materials ar taxic substanccs shal! not be placed in cantair�ers for reguiar collections, but shall be disposed of as directed by the airect_or of solid waste at the expense of the owner_or possessor thereof. {4) Proltibited materials. Biohazardot�s waste, flammable liquids, motar ail, esticides herbicides and other hazardous materials shall not be laced far collection, and shall nat_be collected bv solid waste personnel. {Code 1980, § 54.Q5; Ord. The director of �is�e��� soiid waste is authorized ta exercise Iimited police pnwers to en#'orce th.e provisians of this chapter. These limited police powers shall include the authoriiy tn issue a notice oi viol�tion of a provision of i�is chapter and, folinwing a reinspection after the time specified in the notice for canectivc action, if th�re has not been substantia� c�mpliance with the notice aFviolation, or if the viol�tio� has been corrected but reoccurs, the directc�r of ��e-�e� solid waste may cause a summons to be issued by a sworn police officer of the city for appeaxance in county court, ar may notify t�e code enforccment boazd and req�est a hearin� pursuant to sections 2.218 and 2.219. A natiee oF vialation shal4 describe the nature of the violation, the corrective action necessary to cure the vi�lation, and the time within which corrective actian shall be taken. A notice of violation shall be served in the mann�r set fnrth in section 2.2I6. exaFSir .
