AN ORDINANCE OF THE CITY OF. CLEARWATER, FLORIDA,
VACATING THE WEST 2.5 FEET OF THE EASTERLY 10-
FOOT DRAINAGE AND UTILITY EASEMENT LYING IN LOT
473, MORNINGSIDE ESTATES, UNIT 6B, LESS THE
NORTHERLY 5 FEET; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Robert and Virginia Dunham, owners of real property located in the
City of Clearwater, has requested that the City vacate a portion of the drainage and utility
easement depicted in Exhibit A attached hereto; and
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the general public
that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. The following:
The West 2.5 feet of Easterly 10-foot drainage and utility easement, lying in
Lot 473, Morningside Estates,' Unit 613, less the Northerly 5 feet, as
_ recorded in Plat Book 63, Page 82, of the public records of Pinellas County,
Florida,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public records of
Pinellas County, Florida, following adoption.
