ORDINANCE NO. 6380-99
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO DISHONORED CHECKS, DRAFTS AND MONEY
ORDERS, AMENDING SECTION 2.528, CODE OF
ORDINANCES, TO IMPOSE A SERVICE FEE NOT TO EXCEED
THE SERVICE FEES AUTHORIZED UNDER FLORIDA
STATUTE 166.251 OR 5 PERCENT OF THE FACE AMOUNT OF
THE CHECK, DRAFT OR MONEY ORDER, WHICHEVER IS
GREATER, FOR THE COLLECTION OF A DISHONORED
CHECK, DRAFT, OR OTHER ORDER FOR THE PAYMENT OF
MONEY TO A MUNICIPAL OFFICIAL OR AGENCY.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 2.528, Code of Ordinances, is amended to read:
Sec. 2.528. Dishonored check, service fee.
(1) Any person issuing a check, draft or any other order to the City for the payment
of money, which check, draft or order is dishonored, shall be subject to a service fee In
the amount of $25.00, If the face value does not exceed $50.00; $30.00, if the face
value exceeds $50.00 but does not exceed $300.00; $40.00, If the face value exceeds
$300.00 or 5% of the face amount, whichever is greater, of the check, draft or order.
The service fee shall be in addition to all other penalties imposed by law. Proceeds from
this fee, if Imposed, shall be retained by the City.
(2) Violations involving checks and drafts shall be governed by Florida Statute 832.
Section 2. This ordinance shall take effect immediately upon adoption.
