6277-98Lek ORDINANCE NO. 6277-98 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, READOPTING THE AMENDMENT TO THE FUTURE LAND USE PLAN ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY, PREVIOUSLY ADOPTED BY ORDINANCE NO. 6142-97, TO CHANGE THE LAND USE DESIGNATION FOR CERTAIN REAL PROPERTY LOCATED ON THE NORTH SIDE OF SR 590 WEST OF MCMULLEN BOOTH ROAD, CONSISTING OF, TRACT B, SALL'S LAKE PARK, UNIT B, FROM RESIDENTIAL URBAN TO COMMERCIAL NEIGHBORHOOD; PROVIDING AN EFFECTIVE DATE. WHEREAS, an amendment to the future land use plan element of the comprehensive plan regarding the subject property was previously adopted by Ordinance No. 6142-97, and owing to the pendency, at the time of adoption, of the City's Evaluation and Appraisal Report and the provisions of Florida Statutes Section 163.3187(6) and related provisions of the Florida Administrative Code it is necessary to readopt said amendment in order to assure its effectiveness; and WHEREAS, The City Commission has found that it is in the public interest to have a reduced area for the planned development district; and WHEREAS, the amendment to the future land use plan element of the comprehensive plan of the City as set forth in this ordinance is found to be reasonable, proper and appropriate, and is consistent with the City's Comprehensive Plan, now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The future land use plan element of the Comprehensive Plan of the City of Clearwater is amended by designating the land use category for the hereinafter described property as follows: Property Tract B, Sall's Lake Park, Unit B, according to the plat thereof as recorded in Plat Book 69, pages 81-82, of the public records of Pinellas County, FL (LUP 97-02) Land Use Category From: Residential Urban To: Commercial Neighborhood Section 2. This ordinance shall take effect immediately upon adoption, subject to the approval of the land use designation by the Pinellas County Board of County Commissioners and subject to a determination by the state land planning agency or the Administrative Commission of the State of Florida, as appropriate, of compliance with the Ordinance No. 6277-96 applicable requirements of the Local Government Comprehensive Planning and Land Development Regulation Act, pursuant to § 163.3189, Florida Statutes. The Director of Central Permitting is authorized to transmit to the Pinellas County Planning Council an application to amend the Countywide Plan in order to achieve consistency with the Future Land Use Plan Element of the City's Comprehensive Plan as amended by this ordinance.
