ORDINANCE NO. 5411-93
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE
LAND DEVELOPMENT CODE; AMENDING SECTION 42.21, CODE OF ORDINANCES,
RELATING TO NONCONFORMING USES, TO PROVIDE FOR THE RECONSTRUCTION OR
REPLACEMENT OF STRUCTURES OCCUPIED BY NONCONFORMING SINGLE FAMILY
RESIDENTIAL USES THAT ARE DAMAGED OR DESTROYED IN EXCESS OF FIFTY
PERCENT OF THE REPLACEMENT COST; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1., Paragraph (e) of Subsection (4) of Section 42.21, Code of
Ordinances, is amended to read:
Section 42.21. Nonconformities.
(4) Nonconforming uses. Any nonconforming use of land,' water or a
structure may be continued subject to the following:

(e) Such nonconforming use, if occupying a structure which is damaged or
destroyed in excess of 50 percent of the replacement cost, shall not
thereafter be reestablished; provided, however, tthat -a structure
occupied by a nonconformina single family residential use mav_ be
enlargement over the Qreviously existing structure. subject to full

Section 2. This ordinance shall take effect immediately,upon adoption.
