ORDINANCE NO. 5388-93
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A PORTION OF THE RIGHT OF WAY FOR GULF-TO-BAY
BOULEVARD DESCRIBED AS THE NORTH 10 FEET OF LOT 4 AND
THE NORTH 10 FEET OF THE WEST 163.14 FEET OF LOT 3,
WILLIAM BROWN'S SUBDIVISION OF BAY VIEW, SUBJECT TO A
UTILITY EASEMENT WHICH IS RETAINED OVER THE FULL WIDTH
THEREOF; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Allstate Life Insurance Company, an owner of certain real property
located in the City of Clearwater, has requested that the City vacate a portion
of the right-of-way described herein, and the Public Works Director has
recommended vacation of the remainder of the right-of--way described herein; and
WHEREAS, the City Commission finds that said right-of-way is not necessary
for municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The North 10 feet of Lot 4 and the North 10 feet of the West 163.14
feet of Lot 3, William Brown's Subdivision of Bay View, as recorded
in Plat Book 1, Page 13, of the public records of Hillsborough
County, Florida, of which Pinellas County was formerly a part,
-is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto, except that the City of
Clearwater hereby retains a utility easement over the described property for the
installation and maintenance of any and all public utilities thereon.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3: This ordinance shall take effect immediately upon adoption.
