ORDINANCE NO. 5376-93
AN EMERGENCY ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING
TO THE LAND DEVELOPMENT CODE; AMENDING SECTION 42.24, CODE OF
ORDINANCES, TO PERMIT ELEVATED AIR CONDITIONING AND LIKE MECHANICAL
EQUIPMENT AND ASSOCIATED DECKING AND STRUCTURAL COMPONENTS TO BE
LOCATED IN SIDE SETBACK AREAS; PROVIDING AN EFFECTIVE DATE;
PROVIDING FOR AUTOMATIC REPEAL. .
WHEREAS, the City Commission finds and declar!cting
both public and private welfare exists due to a lim 42.24
of the Code of Ordinances; that the nature of the )y the

BE IT ORDAINED BY THE CITY
CLEARWATER, FLORIDA:
Section 1. Subsection (12) of
amended to read:
Sec. 42.24. Setbacks.

Section 4 1 is
(12) Air conditioning equipment, pool equipment and like mechanical
equipment not enclosed within a building shall be exempt from side and rear
setback requirements provided through access is not obstructed by such equipment.

Section 2. This ordinance shall take effect immediately upon adoption.
Section 3. This ordinance shall stand repealed 90 days following the date
of adoption unless sooner repealed by a nonemergency ordinance on the same
subject adopted prior to such date.
