ORDINANCE NO. 5367.93
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A 30-FOOT WIDE PORTION OF ALLEN AVENUE LYING
SOUTH OF BLOCK 1, ACKER'S SUBDIVISION, EAST OF STATE
ROAD 580 AND WEST OF DANIEL STREET, SUBJECT TO A
DRAINAGE AND UTILITY EASEMENT WHICH IS RETAINED OVER THE
FULL WIDTH THEREOF; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Florida Department of Transportation, in conjunction with the
proposed improvements to State Road 580, has requested the City of Clearwater to
vacate certain right-of-way as described herein, and the City, as owner by deed
of the real property adjoining the property described herein, concurs in the
vacation request and has initiated this ordinance upon the recommendation of the
Public Works Director and City Manager; and
WHEREAS, the City Commission, in consideration of the improvements to State
Road 580, finds that the right-of-way described herein is not necessary for
municipal use, and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
Commence at the Northwest corner of the Southwest 1/4 of Section 28,
Township 28 South, Range 16 East, and go Easterly along the North
boundary of the Southwest 1/4 of Section 28, 71.77 feet, to its
intersection with the Southerly right-of-way line of State Road 580
and the POINT OF BEGINNING; thence Northeasterly along the Southerly
right-of-way line of State Road 580, a distance of 42.48 feet, to
the Southwest corner of Lot 1, Block 1, Acker's Subdivision, as
recorded in Plat Book 30, Page 91, of the public records of Pinellas
County, Florida; ,thence run Easterly along the South line of said
Block 1, also bei'ag the North right-of-way line of Allen Avenue,
368.18 feet to the Southeasterly corner of Lot 16, Block 1, of said
Acker's Subdivision; thence run Southwesterly along the
Southwesterly extension of the Easterly line of said Block 1, 42.48
feet, to its intersection with the North boundary of the Southwest
1/4 of said Section 28; thence Westerly along said North boundary of
the Southwest 1/4 of said Section 28 to the POINT OF BEGINNING.
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto; provided, however, that
the City of Clearwater hereby retains a drainage and utility easement over the
described property for the installation and maintenance of any and all public
utilities thereon.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
