ORDINANCE NO. 5347-93 AN ORDINANCE OF THE CITY Of CLEARWATER, FLORIDA, RELATING TO THE CLEARWATER DOWNTOWN DEVELOPMENT BOARD; AMENDING SECTIONS 2.147 AND 2.148, CODE OF ORDINANCES, RELATING TO ELECTIONS, VOTING, THE FILLING OF VACANCIES, BOARD BYLAWS AND PROCEDURES, AND THE DUTIES OF THE CITY CLERK; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Sections 2.147 and 2.148, Code of Ordinances, are amended to read: DIVISION V. DOWNTOWN DEVELOPMENT BOARD Sec. 2.147. Creation; members. (1) There is hereby created a board composed of seven members to be known as the "Clearwater Downtown Development Board." (2) The S members of the board shall be elected for three-year terms, with two or three members being elected each year, at a date specified in the bylaws, Members shall be elected by the electors and by the designated voting representatives of any corporations or other artificial legal entities owning property within the taxing district and by any other persons owning property within the district. Corporations or other artificial legal entities desiring to designate a voting representative with the board shall do so within two weeks prior to the mailing of the ballots, in the form and manner specified in the bylaws. In any election, each qualified voter shall have the right to write in any additional person on the ballot for each seat to be filled off4ee. Any returned ballot received or postmarked later than the date designated for ballots to be returned twe we?e1FS?;atec than the-date-the bal4ets were ?-mailed shall be null and void. Any ballot containing more der votes than the number of seats to be filled shall be null and void. (3) Two board members shall be elected at each annual election except that three board members shall be elected in 1989 and every third year thereafter. Bylaws; quorum; officers; meetings. (1) The board shall formulate and may amend its own rules of procedure and written bylaws, not inconsistent with this division, by majority vote of the - - - area by written ballets. (2) Four voting members of the board shall constitute a quorum for the transaction of business, but fewer than a quorum may adjourn from time to time and may compel the attendance of absent members. All action shall be taken by vote of at least a majority of the board members present and yeting. (4) The board shall schedule 4e44 regular meetings at least once a month and shall provide in its bylaws for holding special meetings. Regular meetings is otherwise no necessity to have a meeting. All freeholders in the downtown area shall be notified by mail of the time and place of all regular or special meetings and shall have the right to attend and voice opinions at such meetings. IZ r ORDINANCE NO. 5348-93 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, VACATING VARIOUS RIGHTS-OF-WAY AND DRAINAGE AND UTILITY EASEMENTS LYING WITHIN AN AREA BOUNDED ON THE NORTH BY CLEVELAND STREET, ON THE EAST BY MISSOURI AVENUE, ON THE WEST BY MADISON AVENUE, AND ON THE SOUTH BY A LINE 150 FEET NORTH OF AND PARALLEL TO GOULD STREET, AS MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING AN EFFECTIVE DATE. WHEREAS, it has been requested by the Public Works Director of the City of Clearwater, owner of certain real property located in the City of Clearwater, that the City vacate the rights-of-way and drainage and utility easements described herein; and WHEREAS, the City Commission finds that said rights-of-way and easements are not necessary for municipal use and it is deemed to be to the best interest of the City and the general public that the'same be vacated; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: ,i Section 1. The rights-of-way and drainage and utility easements described in Exhibit A attached hereto are hereby vacated, closed and released, and the City of Clearwater quitclaims and releases all of. its right, title and interest thereto.
