5327-9304, P" 1 ORDINANCE NO. 5327-93 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, VACATING THE 16-FOOT EAST-WEST ALLEY LYING BETWEEN GARDEN AVENUE AND PINELLAS TRAIL, IN BLOCK 4, JONES SUBDIVISION OF NICHOLSON'S ADDITION TO CLEARWATER HARBOR, SUBJECT TO A DRAINAGE AND UTILITY EASEMENT WHICH IS RETAINED OVER THE FULL WIDTH THEREOF; PROVIDING AN EFFECTIVE DATE. WHEREAS, it has been requested by Mt. Olive Church, owner of certain real property located in the City of Clearwater, that the City vacate a portion of the alley described herein, and the City recommends that the entire alley in Block 4 be vacated; and WHEREAS, the City Commission finds that said alley is not necessary for municipal use and it is deemed to be to the best interest of the City and the general public that the same be vacated; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following: The 16-foot East-West alley lying in Block 4, Jones Subdivision of Nicholson's Addition to Clearwater Harbor, as recorded in Plat Book H1, Page 13, of the public records of Hillsborough County, Florida, of which Pinellas County was once a part, is hereby vacated, closed and released, and the City of Clearwater quitclaims and releases all of its right, title and interest thereto, except that the City of i4 Clearwater hereby retains a drainage and utility easement over the described property for the installation and maintenance of any and all public utilities thereon. r Section 2. The City Clerk shall record this ordinance in the public records of Pinellas County, Florida, following adoption. 'i Section 3. This ordinance shall take effect immediately upon adoption.
