ORDINANCE NO. 5285-92
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING SPRUCE AVENUE BETWEEN BLOCK 2 AND BLOCK 3, J.H.
ROUSE SUBDIVISION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, it has been requested by Howard R. Jimmie, owner of certain real
property located in the City of Clearwater, that the City vacate the right-of-way
described herein; and
WHEREAS, the City Commission finds that said right-of-way is not necessary
for municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1, The following:
Spruce Avenue, a dedicated street, and a part of J. H. Rouse Subdivision
between Block 2 and Block 3, as recorded in Plat Book H 4, Page 90, of the
public records of Hillsborough County, Florida, of which Pinellas County
was formerly a part, and more particularly described as follows:
Beginning at the Southeast corner of Lot 14, Block 2, for a POINT OF
BEGINNING; thence due East, 40,00 feet to the Southwest corner of Lot 21,
Block 3; thence Northeasterly along the West lot lines of Lots 21, 20 and
19, Block 3, 327.8 feet, to the Northwest corner of said Lot 19; thence
due West, 40.00 feet to a point on the Northeast corner of Lot 18, Block
2; thence Southwesterly along the East lot lines of Lots 18, 17, 16, 15,
and 14, Block 2, 328 feet to the point on the Southeast corner of said Lot
14, and the POINT OF BEGINNING,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 33. This ordinance shall take effect immediately upon adoption.
