ORDINANCE NO. 5268-92
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING THE SOUTH 1.0 FOOT OF THE 10-FOOT DRAINAGE AND
UTILITY EASEMENT LYING WITHIN LOT 78, CLUBHOUSE ESTATES
OF COUNTRYSIDE UNIT TWO, LESS THE EASTERLY 5.0 FEET AND
THE WESTERLY 5.0 FEET; PROVIDING AN EFFECTIVE DATE.
WHEREAS, it has been requested by Russell F. Burr, owner of certain real
property located in the City of Clearwater, that the City vacate the drainage and
utility easement described herein; and
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The South 1.0 foot of the 10-foot drainage and utility easement
lying within Lot 78, Clubhouse Estates of Countryside Unit Two, as
recorded in Plat Book 76, Page 9, of the public records of Pinellas
County, Florida, less the Easterly 5.0 feet and the Westerly 5.0
feet,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.

Section 3. This ordinance shall take effect immediately upon adoption.
