ORDINANCE NO. 5259-92
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING THE WEST 3 FEET OF THE EAST 1.5-FOOT DRAINAGE
AND UTILITY EASEMENT LYING IN LOT 314, MORNINGSIDE
ESTATES UNIT 313, LESS THE NORTH 25 FEET; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, it has been requested by the owners of certain real property
located in the City of Clearwater that the City vacate the drainage and utility
easement described herein; and
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The West 3 feet of the East 7.5-foot drainage and utility easement
lying in Lot 314, Morningside Estates Unit 313, according to the map
or plat thereof as recorded in Plat Book 61, Page 41, of the public
records of Pinellas County, Florida, less the North 25 feet,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto.

Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
