ORDINANCE NO. 5237-92
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE FRANCHISE AGREEMENT WITH GTE FLORIDA,
INCORPORATED, FORMERLY KNOWN AS GENERAL TELEPHONE
COMPANY OF FLORIDA, TO AMEND THE FRANCHISE AGREEMENT TO
EXTEND THE TERM OF THE FRANCHISE FOR A PERIOD OF SIX
MONTHS, ENDING ON DECEMBER 31, 1992, RATHER THAN JULY
1, 1992; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance 1873 of the City granted a nonexclusive franchise for
the use of City rights-of-way to General Telephone Company of Florida, now known
as GTE Florida, Incorporated (herein, "GTE"), for a term of 15 years, such term
ending on January 1, 1992; and
WHEREAS, the term of the franchise was extended to July 1, 1992, by
Ordinance 5150-91 passed and adopted on January 2, 1992; and
WHEREAS, additional time is required for the preparation of materials
necessary for discussions between the City and GTE on a successor franchise
agreement; and
WHEREAS, GTE agrees to the extension of the franchise term to allow for
such preparations; now, therefore,

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The term of the franchise agreement between the City of
i Clearwater and General Telephone Company of Florida, now known as GTE Florida,
Incorporated, granted by Ordinance 1873 of the City and extended by Ordinance
5160-91 is hereby extended six months such that the term shall expire on December
311 1992. All other provisions of Ordinance 1873 shall continue in full force
and effect.
Section 2. This ordinance shall not be construed to infer that the term
of the franchise shall again be extended, or that GTE shall be approved as a
