r AN ORDINANCE OF THE CITY, OF CLEARWATER, FLORIDA,
VACATING THE EASTERLY 5 FEET OF THE WESTERLY 10-FOOT
UTILITY EASEMENT LYING IN LOT 41, COUNTRYSIDE TRACT 56
12- UNIT 2 SUBDIVISION, LESS THE NORTHERLY 5 FEET; PROVIDING
AN EFFECTIVE DATE.
WHEREAS, it has been requested by James C. and Linda S. Garrett, owners of
certain real property located in the City of Clearwater, that the City vacate the
utility easement described herein; and
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following;
The easterly 5 feet of the westerly 10-foot utility easement, less
the northerly 5 feet thereof,lying.in Lot 41, Countryside Tract 56
Unit 2 Subdivision, according to the map or plat thereof as recorded
in Plat Book 80, Pages 36 and 37, of the public records of Pinellas
County, Florida,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and -interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
