AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING THE RIGHT-OF-WAY OF PINE STREET LYING NORTH OF
BLOCKS I AND 2 AND SOUTH OF BLOCKS 3 AND 4, STARR AND
SAVERY'S ADDITION TO CLEARWATER, FLORIDA, SUBJECT TO A
DRAINAGE AND UTILITY EASEMENT WHICH IS RETAINED OVER THE
FULL WIDTH THEREOF, AND A DESIGNATED FIRE LANE AND
DESIGNATED NO-PARKING ZONES BEING PROVIDED; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, it has been requested by Church of the Ascension, owner of certain
-real property located in the City of Clearwater, that the City vacate the right-
of-way described herein; and
WHEREAS, the City Commission finds that said right-of-way is not necessary
for municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated with certain conditions listed below;
now, therefore,

releases all of its right, title and interest thereto subject to the following
conditions:
1. The City of Clearwater hereby retains a drainage and utility easement
over the described property for the installation and maintenance of any and all
public utilities thereon.
2. A 20-foot-wide designated fire lane shall be provided on the north
side of the sanctuary with approved signs beginning 15 feet from Bay Avenue and
at 30-foot intervals thereafter as shown on Exhibit A attached hereto. The fire
lane signs shall be provided by the owner at the owner's expense. Active loading
and unloading are the only activities permitted in a fire lane.
3. Designated no-parking zone signs shall be provided by the City at the
fire hydrant; on Orange and Bay Avenues.
