5154-910 ORDINANCE NO. 5154-91 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE ADMINISTRATION OF THE CITY; CREATING SECTION 21.04, CODE OF ORDINANCES, RELATING TO THE DEPARTMENTS OF THE CITY; REPEALING CHAPTER 28, CODE OF ORDINANCES, RELATING TO THE DEPARTMENTS OF THE CITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the provisions of Chapter 28, Code of Ordinances, relating to the departments of the City, have been reviewed with the objective of "sunsetting" those provisions which are included in or conflict with the City Charter, or which no longer continue to serve a useful purpose; and WHEREAS, Section 3.03 of the City Charter establishes the powers and duties of the city manager, including the establishment and discontinuance of any department, division or board in the administrative affairs of the City, subject to City Commission approval; and WHEREAS, it has been determined that Chapter 28 of the Code of Ordinances should be repealed in its entirety in order to eliminate numerous provisions which have become obsolete, and to permit the city manager to reorganize the departments and divisions of the City and to reassign their functions and duties without the formalities of adopting ordinances; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF : CLEARWATER, FLORIDA: Section 1. Section 21.04, Code of Ordinances, is created to read: Sec. 21.04. Departments. The city manager shall establish the organization, composition, functions, and duties of the administrative departments and divisions of the city. The city manager shall appoint the directors of the departments and divisions, and shall establish the powers and duties of the officers and employees so appointed. Provided, however, that the establishment or discontinuance of any department or division shall be subject to City Commission approval. ,i .5-V _ j/ z • A Section 2. Chapter 28, Code of Ordinances, consisting of Sections 28.001 through and including 28.07, is hereby repealed. Section 3. This ordinance shall take effect immediately upon adoption.
