ORDINANCE NO. 5121-91
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING THE NORTH 3.5 FEET OF A 7.5-FOOT UTILITY
EASEMENT LYING ON THE SOUTH SIDE OF LOT 11, BLOCK 24,
5TH ADDITION TO HIGHLAND PINES SUBDIVISION, LESS AND
EXCEPT THE WEST 25 FEET THEREOF; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, it has been requested by Jean Melmoth, owner of certain real
property located in the City of Clearwater, that the City vacate the utility
easement described herein; and
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The North 3.5 feet of a 7.5-foot utility easement lying on the South
side of Lot 11, Block 24, 5th Addition to Highland Pines
Subdivision, as recorded in Plat Book 36, Page 44, of the public
records of Pinellas County, Florida, less and except the West 25
feet thereof,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
