ORDINANCE NO. 5119-91
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A 5-FOOT UTILITY EASEMENT LYING ALONG THE EAST
LOT LINE OF LOTS 1 THROUGH 6, BLOCK 40, MANDALAY
SUBDIVISION, PINELLAS COUNTY, FLORIDA; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, it has been requested by Patrick and Gail O'Connell, owners of
certain real property located in the City of Clearwater, that the City vacate the
utility easement lying along Lot 1, Block 40, Mandalay Subdivision; and
WHEREAS, the Public Works Director has also requested that the utility
easement lying along Lots 2 through 6, Block 40, Mandalay Subdivision, also be
vacated;
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The 5-foot utility easement lying along the East lot line of Lots 1
through 6, Block 40, Mandalay Subdivision, as recorded in Plat Book
14, Pages 32 through 35, of the public records of Pinellas County,
Florida,

is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
