certain property known as:
The Southwest 1/4 of the Northwest 1/4 of
Section 33, Township 28 S, Range 16E,
Pinellas County, Florida.
In connection with the Petition for Annexation and Rezoning
of said property, it is our understanding that the City
Commission has requested a written acknowledgement from our
clients or their authorized representatives concerning the
property owners' intentions in connection with the dedica-
tion of 10% of the net property area or a cash payment in
the amount of 10% of the appraised land value to be contri-
buted by the owners of the property to the City for the
purposes of park acquisition or development.
Please consider this letter as a reaffirmation of our clients'
desire to comply with all the requirements of the City of
Clearwater, including the dedication of the open space re-
quirement in consideration of the City's agreement to annex
this property, rezone same to the RS-75 zoning classification
and the guarantee of the City to provide water and sewer
services for the development of the approximate 105 lots in
the Shady Oaks Farms Subdivision. The property owners and/or
their assigns have previously agreed to develop the property
in accordance with the applicable regulations, restrictions
and requirements of the City of Clearwater including the dedi-
cation of 60 foot right-of-ways for the interior streets
located within the subdivision, paving the streets to the

lieu thereof or a combination of both. Our clients under-
stand and appreciate that the annexation, rezoning and guarantee
of water and sewer services for the development of the lots in
the subdivision is a valuable consideration for which they are
willing to respond in a like--kind exchange of their valuable
property rights.
As you know the various members of the Resource Development
Committee of the City and the representatives of the property t.
owners have been negotiating with regard to the actual property
to be dedicated to comply with the open space requirement and
we are advised that an agreement with regard to same is very
close to being concluded. However, we sincerely hope that this
communication serves the purposes requested by the City Com-
mission to confirm the property owners' intentions in connection
with compliance by the former. We will appear at the City
Commission meeting on September 21, 1978 to answer any questions
that the Commission or staff has with regard to this matter.
